민간치안서비스 규제인식에 대한 비교연구 (Analysis for a Regulatory Compliance of the Security Service in the Republic of Korea)

초록

Traditionally, a security service has been recognized as a part of government sector. These arguments were continuously supported by many scholars up until 1980, and most scholars defined that the security services become one of representative public services and facilities role which was responsible to a nation. Along with end of the Cold War, theory of the small government, which was based on new liberalism, become magnified,a new problem about utilization of expanded interpretation for a policing service was began to discussed between scholars and professionals.
It also has experienced an important changeover in government paradigm to transfer a function which was being considered as a part of a government or a public sector in past decades. Reinforcing efficiency Korea government introduceda competition principle to the public services.
Most public service area have been tried various changes such as cooperation with private sector, contracting out, and privatization. But, In the area of security services regulation, the government presented its difficulties to find an appropriate regulatory alternative which is in accord with diversified characteristics of security services. Thus, private responses a regulatory non-compliance toward impractical regulation which became an obstacle to industrial revitalization.
This study classify into a security service characteristic complied to service characteristic not to focus on supplier perspective. and this study expanded its area from theoretical limitation and established a standard of practical regulatory alternative. Draw a objective and systematic regulatory alternative, this study conducted an empirical analysis for a regulatory practical study and a regulatory compliance. Through the regulatory practical research, primarily the problem of private security service found.
While selecting commonly recognized problems both regulators and regulatee, objective and systematic regulatory alternative would be found.
The research results emphasized that the regulation alternatives in the private security service need to be improved and modified to the four kinds of aspects. First, through a regulations delay such as a temporary regulation, a regulation abolition should be lead. Second, an accuracy of demand forecast should be increased through an economic incentive and a co-regulation, Third, expand the range of duty as well as solve problems with information distortion, capture, and entry barrier through establishing education market liberalization. Finally, permission or selection method and selection criteria for a regulate need to be operate within a unified regulation.
It was still in the beginning stages of research to arrange appropriate regulatory alternative by service characteristic, and has a lot difficult to graft analyze practical regulation onto set-up process of regulatory alternative to empirical analysis. It presented limitation to increase connectivity among each small unit research, through consistent research,these problems need to be solved. This study will work as a guidance in the area of security services as well as provide a direction for regulation policy of public services, especially for encouraging private participation.
