재난 발생시 경찰의 초동조치에 관한 연구 (A Study on the Initial Measures and Role of the Police in the event of a national disaster)

초록

최근 중국에서 발생한 코로나 19로 인하여 국민 모두가 경제적 생활고와 고립감, 질병에 대한 두려움 등으로 인하여 많은 고통을 받고 있다. 이에 따라 국민의 안전에 대한 관심이 높아지면서 재난상황의 발생시 국가가 이를 관리할수 있는 시스템을 갖추고 있는가에 대해 관심이 높이지기 시작하였다. 경찰은 전통적으로 법집행, 범죄예방 및 대응, 그리고 치안서비스를 제공하는 역할을 담당한다. 이러한 본연의 역할 이외에 국가적 재난 및 위기사태 시 지원기관으로서 국가 및 지자체 등을 지원하는 역할도 동시에 담당해야 한다. 감염병의 발생 시 경찰은 자가격리 이탈자들을 감시하는 것뿐만 아니라, 관련 의료물품의 사재기 및 사기사건 예방 및 대응 등 다양한 임무를 수행해야 한다. 이에 따라 코로나 19라는 사상초유의 사태에서 경찰은 경찰인력과 장비를 격리시설 등 질병과 관련한 여러 곳에 지원하고 의심환자 검사 거부 시 강제력 사용, 접촉자에 대한 동선파악, 소재확인 등을 실시하며 불안을 야기했던 가짜 뉴스 유포자 검거 등 코로나 19의 확산 방지를 위해 많은 역할을 수행하였다. 하지만 광화문 집회 등 집회시위를 통제하러 출동하였던 경찰관들이 감염되는 등 많은 문제가 발생하기도 하였다.
이 연구는 코로나19와 같은 국가적 재난발생 시 경찰의 역할 및 초동조치에 관련하여 문제점을 밝히고 이에 대한 개선책에 대해 논하였다. 재난관리의 대응과 대비가 경찰이 전담하는 것이 최적이라고 보기는 어렵지만, 경찰은 최소한의 재난장비 확보, 24시간 비상근무체제와 신고접수에서 현장출동에 이르기까지의 경찰종합상황실의 운영, 훈련된 전문 인적자원을 확보해야할 필요성이 있다. 또한, 경찰은 단일화된 지휘체제 확립과 재난관리의 구체적인 종합계획, 부서별 매뉴얼 구축, 재난관련 순찰활동의 역할 활성화, 재난관련 정보의 확보, 종합정보통신 네트워크 구축, 교육훈련 프로그램 마련 및 개발 등이 재난관리 대응을 제고하기 위해 모든 노력을 기울여야 할 것이다

영어초록

The COVID19 in Wuhan, China, is causing everyone to suffer. As the public's interest in safety has increased, not only in security situations, but also in crime, terrorism and disaster and disaster situations, attention has begun to grow to see if the national system that manages them works properly.
Police traditionally play a role in law enforcement, crime prevention and response, and providing security services. In addition to these original roles, the government should also play a role in supporting the state and local governments in the event of a national disaster and crisis. In the event of an infectious disease, the police should not only monitor the self-price deviant, but also perform various duties such as hoarding related medical supplies and preventing and responding to fraud. Accordingly, in the unprecedented situation of COVID19, the police provided police personnel and equipment to various places related to diseases such as isolation facilities, and played many roles to prevent the spread of COVID19, including the use of force when denying examination of suspected patients, the identification of movements, and the arrest of fake news distributors who caused anxiety. However, there were many problems, including the infection of police officers who were dispatched to control the rally, including the Gwanghwamun rally.
The study identified problems related to the role of the police and initial measures in the event of a national disaster such as COVID19, and discussed the revision of related regulations such as the Act 1, the strengthening of related education and training, 3. the production of manuals for initial measures, 4. the strengthening of the disaster capabilities of local governments, 5. Securing an immediate response system for daily response measures, and 6. securing experts in initial measures related to disasters. Although it is difficult to say that it is best for the police to take full charge of disaster management, the police need to secure minimum disaster equipment, operate a 24-hour emergency work system and a police general situation room from receiving reports to on-site dispatch, and secure trained professional human resources. In addition, the police will have to make every effort to enhance the response of disaster management by establishing a unified command system, detailed comprehensive plan for disaster management, establishing a manual for each department, activating the role of disaster-related patrol activities, securing disaster-related information, establishing a comprehensive information and communication network, and preparing and developing education and training programs.
