중국 농촌토지에 건설된 소산권주택의 재산권 처리방안에 관한 연구-선쩐시와 베이징시를 중심으로 (A Study on the Treatment of Property Rights of SPRs Constructed in Rural Land of China-Focused on Shenzhen and Beijing)

초록

소산권주택이란 농촌토지에 건설된 주택을 매수가 불가능한 외지인에게 판매된 불법 주택을 말한다. 소산권주택이 중국사회에서 주목받는 이유는 전국에 2억 명이 넘는 사람이 거주하기 때문이다. 중국정부는 소산권주택을 강제 철거한다는 원칙을 내세우고 있지만 이미 방대한 규모로 성장한 소산권주택을 일괄적으로 철거한다는 것은 불가능하다. 이로 인해 출현한 것이 소산권주택의 분리처리정책이다. 분리처리란 일정한 기준에 부합하는 소산권주택은 합법화하고 중대한 위법사항이 있는 것은 강제철거 한다는 것이다. 본 연구의 목적은 선쩐시와 베이징시를 통해 분리처리의 기준과 합법화 방식의 유효성을 확인하는 것이다. 연구결과는 다음과 같다. 첫째, 현재 건설 중이거나 판매 중인 소산권주택은 강제 철거한다. 둘째, 현재 판매중인 소산권주택 가운데 토지이용계획과 도시계획에 부합되고 품질과 안전기준이 충족되는 전제 하에 현실에 맞는 보상기준을 제시해야 한다. 나아가 소산권주택을 근본적으로 해결하려면 농촌토지의 무상분배제도를 개혁하고 농촌토지와 도시토지에 동등한 권리를 부여해야 한다.

영어초록

The purpose of this paper is to investigate the legalization methods for SPRs related to land reform and property right reform in China. SPRs are referred to as an illegal house sold to outlanders that cannot trade a house constructed in farm land. The reason why SPRs receive much attention in Chinese society is that more than 200 million people live in 70 million SPRs across China. Another reason is that SPRs are related to interests of various groups such as farmers, collective governments, developers and buyers. The Chinese government announced the forcible removal of SPRs, but it is impossible to remove all massive number of SPRs at once. The alternative way is the classification treatment of SPRs. According to the classification treatment, SPRs which meet certain criteria are legalized but SPRs which substantially violate the law are forced to remove.
The purpose of this study is to examine the validity of the criteria and legalization methods of classification treatment in Shenzhen and Beijing. The second purpose of this study is to find a solution for the legalization of SPRs. The results of the study are as follows. First, SPRs which are currently under construction or on sale should be strictly forcibly removed and the increase of SPRs should be suppressed. Second, each area should establish the criteria for procedures and costs for the legalization of SPRs which are appropriate for the area when the sale for SPRs is completed. Third, among SPRs being sold, the SPRs which meet certain conditions should be used as public rental houses or public facilities after confiscation. However, actual and appropriate compensation standards should be presented to solve the problems of SPRs. Furthermore, the free distribution system of rural land should be reformed and equal rights should be given to rural land and urban land to fundamentally solve the issues of SPRs.
