인권조례 제정 운동의 성과와 한계 -광주광역시, 전북, 울산광역시 인권기본조례를 중심으로 (A Study on the Legislation Movement of Human Rights Ordinance in the Local Level －Focusing on Gwangju Metropolitan City, Chonbuk Province, Ulsan Metropolitan City－)

초록

한국사회에서는 1990년대 이후 활기를 띠게 된 인권운동과 인권법들의 제정을 배경으로 하여 2000년대에 들어서서 지역차원에서 인권조례운동이 시작되었다. 지방자치단체의 인권조례의 제정이 과연 지역 공동체 안에서 인권을 증진하는데 얼마나 기여할 수 있을 것인가? 지역사회에서 인권보장의 실현을 위해서는 인권조례의 조문 내용만 살펴볼 것이 아니라 입법운동의 맥락에서 조례를 고찰할 필요가 있다. 이 논문은 지방자치단체의 인권조례제정운동을 살펴보고 그것의 내용과 집행에 영향을 끼치는 요인들을 분석해 보고자 한다.
이 연구에서는 일반적 인권조례(인권기본조례로 통칭)로서 광역자치단체의 사례 두 개(광주광역시 인권조례와 전북인권조례)와 기초자치단체의 조례 3개(울산광역시 북구 조례, 부산광역시 수영구와 해운대구 조례)를 살펴보았다. 본론에서 분석한 진주시 사례에서 살펴본 바와 같이 인권운동이 조례제정운동을 추진한다고 해서 반드시 입법이 성공적으로 이루어지는 것도 아니며, 조례가 제정되더라도 인권조례의 존재 자체가 지역사회에서 인권실현에 기여하는 것은 아니다. 울산광역시에서는 비록 광역시 차원에서 조례가 제정되지는 못했을지라도 진보세력의 힘이 우세한 북구에서 내실 있는 조례가 제정되었고 그 집행 또한 순조롭게 진행되고 있다. 2007년에 제정된 광주광역시의 인권도시육성조례는 지역인권위원회가 자치단체장의 자문기구에 불과하거나 인권기본계획의 내용이 그저 선언적, 상직적인 수준에 머문다면, 인권조례는 인권보장에 별로 기여할 수 없다. 전북조례는 위원회의 독립성도 어느 정도 보장되고 전담업무를 담당할 기구인 인권센타도 존재하며 자치단체장의 책무인 인권교육에 대해서도 의무사항으로 규정하고 있어 내용상으로는 인권조례들 가운데 가장 이상적이다. 그러나 전라북도 지방정부는 그것을 시행하지 않고 있고 입법자들인 도의회 의원들조차 인권조례의 시행에 무관심하다. 전북지역사례는 인권조례제정운동은 조례제정에 성공한 이후에도 조례의 집행과 지역사회 내의 인권제도화를 위해 꾸준히 운동을 계속해야 한다는 것을 보여준다.
이 연구는 궁극적으로 인권조례를 집행하는 힘은 시민사회에서 나온다는 것을 보여준다. 지역주민의 참여와 시민사회 내의 공론화는 조례를 집행하게 하는 힘을 담보해준다. 다른 조례들과 달리 인권조례는 조례에 담아야 할 인권의 내용 못지않게 입법의 과정이 특히 중요하다. 조례의 입법과정에서 이루어지는 주민의 참여와 토론은 살아있는 인권교육이며 인권신장의 한 과정이다.
지역인권운동단체들은 인권전문기구인 국가인권위원회의 정보와 자원을 활용하고 이미 조례가 제정된 다른 지역의 경험들을 참고하여 자신들이 속한 지역사회의 특성과 정치지형 속에서 시민참여를 유도하고 인권의제를 공론화해야 할 것이며, 조례의 내용, 입법방식 등을 선택해야 할 것이다. 조례의 제정 후에도 지역사회 차원에서의 인권의 제도화를 위해 조례의 집행과 개정을 위한 감시활동을 계속해야 할 것이다.

영어초록

Does human rights ordinance contribute to improvement of human rights in the local community? This research aims at examining the legislation movements of municipal human rights ordinance and explaining the factor which has had effects on the enforcement of it. The legislation movements of municipal human rights ordinance occurred in Korea after around the year 2000 and brought forth 2general human rights ordinances in Gwangju Metropolitan City and Chunbuk Province in the metropolitan level and three ordinances in the district level in Ulsan and Busan Metropolitan City. This movements is motivated by legislation of human rights laws in the national level since 1990s.
Cases of general(basic) human rights ordinances in the metropolitan level analyzed in this paper are the human rights ordinances of Gwangju Metropolitan City and Chunbuk Province .Three cases of general human rights ordinances examined in the district level are the human rights ordinances of Hae-undae District(in Busan), Sooyoung District(in Busan), and North District(in Ulsan),Ulsan Human Rights Movements Solidarity started the legislation movements in Korea for the first time. They finally enacted human rights ordinance in the Northern District. It is the outcome of the legislation movements even if they failed law-making in the entire metropolitan city level because of conservativeness of regional politics. Jinju City in Gyungnam Province is the second region to get the legislation movements started in Korea. But human rights ordinance has not yet been enacted in this region due to the conservativeness of municipal assembly although movements has lasted for a long time.
Gwangju Metropolitan City and Chunbuk Province enacted human rights ordinances successfully. The new executive of Gwangju local government is implementing the ordinance through the establishment of special executive department within the city administration organization and the allocation of finance for the first time in Korea. On the contrary, Chunbuk local government has not made any effort to enforce the ordinance. Contents of Chunbuk ordinance is most progressive since it prescribes not only the allocation of finance and the establishment of human rights center but also the obligation of local government carrying out the human rights education. It also regulates the establishment of the independent local human rights committee in 6 months after it’s enforcement.
Chunbuk human rights movements group fulfilled the enactment of the human rights ordinance effectively and rapidly owing to the lesson of other precedent movements. They still push the pressure on the governor and the legislators in the prefectural assembly to realize the ordinance in the community.
Legislation process such as the human rights issue-making, the construction of public opinion in the local civil society and the suggestion in the municipal assembly is very important in making human rights ordinance. The entire legislation process is a kind of human rights education as well as an another step towards promotion of human rights in the local community.
Local human rights movement group can take lessons from the precedent legislation of the municipal ordinance in another region and make a decision about the contents of ordinance and the way of legislation, considering the characteristics of the local political configuration. They can also utilize the resources of the National Human Rights Commission.
