중국에서의 가상자산 상속에 관한 법적 고찰 (A Legal Investigation into the Succession of Virtual Property in China)

초록

통상 가상자산이란 컴퓨터 등에 정보 형태로 남아 실물 없이 사이버상으로만 거래되는 자산의 용어를 의미한다. 오늘날 가장자산은 인터넷 발전과 더불어 출현된 일종의 자산으로서 그 특징과 유형이 전통적 자산과 구별되기 때문에 법적 쟁점으로 떠오르고 있다. 가상자산의 범위에 관하여 광의설과 협의설2가지가 있다. 광의설을 살펴보면 가상자산은 온라인 가상공간 내에 존재하는모든 가상자산을 가리키고, 이메일, 온라인 계정, 가상화폐, 온라인 게임 속 가상물품 및 장비, 등록된 도메인 등이 포함된다. 협의설을 살펴보면 가상자산이란 게임 계정의 등급, 게임머니, 게임 캐릭터 등 온라인 게임에 존재하는 가상자산을 말한다. 본 연구에서 가상자산은 온라인 가상공간을 기반으로 하여 생기는 자산을 말하고, 계정류 가상자산, 물품류 가상자산, 화폐류 가산자산 등3종 유형으로 분류된다. 본 연구는 가상자산을 연구대상으로 하여 특히 가상자산의 상속여부 문제에 대하여 분석 및 논의하고자 한다. 가상자산의 상속여부에 대하여 학술계와 실무계에서 많은 토론이 초래되었다. 현재 중국 학계에서가상자산의 재산속성에 관해서 물권설, 채권설, 지적재산설, 신형 재산설 등 다양한 주장이 제기되고 있다. 생각건대 온라인상 가상자산의 재산속성에 대해서 일괄적으로 판단할 것이 아니라, 가상자산의 특징에 따라서 유형별로 판단해야 한다. 뿐만 아니라, 가상자산에 대해서 상속이 가능하다고 판단하는 때에는 통상 온라인 이용약관과 충돌되거나 개인 프라이버시권을 침해하는 법적문제가 발생할 수 있다. 이 외에도 가상자산의 가치에 대해서 제대로 평가해야만 가상자산 원활한 상속과 분할을 진행할 수 있기 때문에 그 해결방안을 모색하는 것도 매우 의미가 있다.

영어초록

Virtual property is a kind of property type that appears with the development of network. Its characteristics and types are different from traditional property, so it has become the focus of legal debate. As for the scope of “virtual property”, there are two mainstream views in academic circles. In a narrow sense, virtual property refers to the virtual property existing in online games, including the level of game accounts, game currency, game characters and so on. Broadly speaking, it is believed that virtual property should refer to all virtual property existing in the virtual space of the network, including E-mail, network accounts, virtual currency, virtual goods and equipment in online games, registered domain names, etc. The author believes that virtual property refers to the property generated by relying on the network virtual space, which is mainly divided into three categories. They are account type virtual property, item type virtual property and currency type virtual property. This paper will take the virtual property as the research object, especially the problem of whether the network virtual property can be inherited, whether the network virtual property can be inherited has caused a lot of discussion in the academic and practical circles. At present, Chinese academic circles have put forward many propositions about the property attribute of virtual property, such as the theory of real right, the theory of creditor’s right, the theory of intellectual property and the theory of new property. The author thinks that the property attributes of network virtual property should not be judgeduniformly, but different types of judgments should be made according to the characteristics of virtual property. At the same time, if the virtual property can be inherited, it usually conflicts with the content stipulated in the user agreement or infringes on personal privacy. In addition, only by correctly evaluating the value of virtual property can we successfully inherit and divide virtual property. Therefore, it is also of great academic value to explore the solutions to the above problems.
