스트리밍 링크 사이트와 온라인서비스제공자의 저작권 침해 - 방조의 법리와 입법론적 개선을 중심으로 - (Streaming Link Site and Online Service Provider’s Infringement of Copyright - Focused on Legal Principle of Aiding and Legislative Improvement -)

초록

스트리밍 링크 사이트 OSP는 불법저작물 업로드 사이트의 링크를 설정 및 게시하여 이용자들에게 불법저작물로 접근하는 경로를 제공하고 배너광고 등을 통해 수익을 얻는다. 이는 불법저작물을 전송하는 사이트에 대한 이용자들의 실질적인 접근가능성을 제고시키는 것으로써, 권리자와 관련 산업에 저작권 침해로 인한 상당한 피해를 가져오고 있다. 그러나 현행 저작권법상 링크행위는 저작권 침해행위의 구성요건을 충족하지 못하므로, 스트리밍 링크 사이트 OSP는 저작권 직접침해에 대한 책임은 부담하지 않는다. 그러나 서울고등법원 2017. 3. 30. 선고 2016나2087313 판결에서는, 이전까지 링크행위에 대해 소극적으로 대응하여 온 판례의 입장과 달리 스트리밍 링크 사이트 OSP의 임베디드 링크행위가 불법저작물 업로드 사이트 OSP의 전송권 침해행위에 대한 방조임을 판시하였다. 위 판결은 새롭게 대두된 저작권 침해의 양상인 링크행위에 대하여 처음으로 법적 책임을 인정하였다는 점에서 의의가 있다. 그러나 판단의 대상이 임베디드 링크와 불법저작물 업로드 사이트에 대한 링크행위에만 한정되어 있어, 일차적 스트리밍 링크 사이트의 링크를 다시 게시하는 이차적 링크행위와 같은 더욱 세분화, 다양화된 저작권 침해 형태에 모두 적용될 수 없다는 한계가 존재한다. 이에 본 연구는 이용자가 스트리밍 링크 사이트를 이용할 때 발생하는 일시적 복제를 중심으로 이용자의 일시적 복제권 침해행위에 대한 스트리밍 링크 사이트 OSP의 방조를 인정하여야 한다는 새로운 견해를 제시함으로써, 스트리밍 링크 사이트의 모든 링크행위를 포괄하여 관련된 문제를 일관되게 해결하고자 하였다.
다만, 스트리밍 링크 사이트의 저작권 침해행위는 최근 논의되고 있는 문제로서 아직 이와 관련된 대법원의 적극적인 판시도 없으며, 기존의 대응방안과 법리로써 이를 효과적으로 제재하는 것이 어려운 실정이다. 이에 본 연구는 스트리밍 링크와 관련된 문제에 대한 대응방안을 검토하고, 스트리밍 링크 사이트의 저작권 침해행위를 규율하기 위한 입법론적 개선방안을 제시하였다. 보다 구체적으로, 현재 시행되는 해외사이트 접속차단 절차의 비효율성을 해소하기 위하여, 현행 정보통신망 이용촉진 및 정보보호 등에 관한 법률 제44조의7의 내용을 바탕으로 접속차단 조치의 법적 근거로 삼는 규정을 저작권법 제10장 보칙에 신설할 것을 제안하였다. 또한, 영리적 목적으로 링크행위를 하는 OSP가 특수한 유형의 OSP 범위에 포함될 수 있도록 관련 문화체육관광부 고시를 개정할 것을 제안하였다.
본 연구는 서울고등법원의 판결을 바탕으로 스트리밍 링크 사이트 OSP의 방조책임 인정여부를 확인하고, 나아가 이용자의 일시적 복제권 침해에 대해 새로이 논의하여 링크로 인한 다양한 침해행위들에 일관되게 적용할 수 있는 법리를 제시한 데에 의의가 있다. 한국도 국제적 흐름에 맞게 링크행위의 저작권 침해에 대한 검토가 필요하며, 이에 본 연구가 관련 법률의 해석에서 참고될 것으로 기대된다.

영어초록

Streaming link site OSP sets up internet links to the unauthorized works upload sites, post them to provide its users with a path to access unauthorized works, and get profits from banner advertisements, etc. These links increase users' substantive accessibility to sites that transmit unauthorized works, which are causing considerable damage to the right holders and related industries. However, since the link acts don't fulfill the components of copyright infringement in the current copyright laws, streaming link site OSP doesn't take the responsibility for direct infringement of copyright. Nevertheless, the decision of 2016나2087313 sentenced by Seoul High Court on 2017. 3. 30. ruled that the embedded link act of the streaming link site OSP was aiding of infringement of copyright by the unauthorized works upload site OSP, contrary to precedents that have previously reacted passively to the link acts. The above decision is meaningful in that it was the first to acknowledge legal responsibility for the link acts as a new aspect of infringement of copyright. However, since the subject of decision is limited to embedded links and link acts to unauthorized works upload sites, that decision cannot be applied to both more granular, diversified forms of infringement of copyright, such as secondary link acts that re-post links to primary streaming link sites. Thus, this study presented a new opinion that the streaming link site OSP's aiding liability regarding user's infringement of right of temporary reproduction should be acknowledged, focusing on temporary reproduction that occurs when users use the streaming link site. In this way, this study try to consistently resolve related issues, covering all link acts of streaming link site.
However, there is no case that the Supreme Court ruled actively regarding the matter of copyright infringement by streaming link sites, and therefore it is difficult for the matter to be effectively sanctioned with the existing countermeasures and legal principles. Accordingly, this study reviewed countermeasures to the problems related to streaming links and suggested legislative improvements to discipline copyright infringement of streaming link sites. More specifically, to address the inefficiency of the current procedures for blocking access to overseas sites, this study proposed that the provisions as the legal basis for access blocking should be added to the provisions of Chapter 10 of the Copyright Act, based on Article 447 of Act on Promotion of Information and Communications Network Utilization And Information Protection. In addition, this study proposed that the public notice of the Ministry of Culture, Sports and Tourism regarding the special types of OSP should be revised, so that OSP posting links on the purpose of seeking profit could be included in the scope of special types of OSP.
This research is meaningful in confirming whether the streaming link site OSP is responsible for aiding based on the decision of the Seoul High Court and presenting legal principles, which can be applied consistently to various acts of infringement caused by the link, by discussing the user's right of temporary reproduction. Korea also needs to review the infringement of copyright by linking in line with international trends, and this research is expected to be referenced in the interpretation of relevant laws.
