초록

현대국가의 규율구조와 규제메커니즘은 점차 변하고 있다. 일방적이고 고권적인 규제 대신 자율규제가 강조되고 있으며, 국가의 규제도 자율규제를 가능하게 하는 조종의 의미를 가진다. 규제의 개념은 다의적이지만, 경제규제에 제한된 전통적 개념만으로는 현대국가의 규제전략을 수립하기가 어렵다. 현대국가의 규제개념은 자율규제를 전제로 하여 이해되어야 한다. 자율규제는 환경, 정보통신, 회사법이나 제품안전법, 대학ㆍ연구기관 등에서 인정되고 있다. 그러나 자율규제도 법치국가원리, 민주적 정당성, 책임성 등의 관점에서 여러 가지 문제점을 가지고 있다. 이를 극복하기 위한 규제개념으로 영국의 메타규제, 독일의 규제된 자율규제 등이 등장하고 있다. 규제된 자율규제에서는 국가와 사회의 협력적 규제가 의미있다. 규제거버넌스에서는 국가가 법제정을 하고, 사회는 내부의 표준을 설정한다. 대학, 이익단체 등의 기능적 자치가 이루어지는 영역에서 규범제정을 할 수 있는지가 논의되고 있다. 대학의 학칙도 그러한 사례의 하나이다. 규제거버넌스에 기반한 협력적 법제정에 있어서 사인의 규범제정을 국가의 법체계에 연결하는 것이 중요하다. 민주적 정당성이 확보되기 위해 이해관계인의 참여나 조직의 투명성, 결정의 수용 등이 보장되어야 한다. 그러나 규제된 자율규제가 성공하기 위해서는 국가의 역할과 책임이 중요하며, 국가의 규제는 더욱 현명하고 합리적이어야 한다. 이러한 행정법학의 구조변화와 규제패러다임의 변화에 따라 새로운 규제개념과 규제전략을 수립해야 한다.

영어초록

The regulation structure and regulatory mechanisms of modern countries are changing gradually. Self-regulation is emphasized instead of one-sided and compulsory regulations, and regulations of the state have the meaning of steering which enables self-regulation. The concept of regulation is multifaceted, but it is difficult to establish a regulatory strategy in the modern state with only a traditional concept restricted to economic regulation. The concept of regulation in modern countries should be understood on the assumption of autonomous regulation. Self-regulation is recognized in the fields of environment, information and communications, corporate law, product safety law, and universities and research institutes etc. However, self-regulation has various problems in terms of rule of law, democratic legitimacy, and accountability. As concepts of regulation to overcome this, meta-regulation in the UK and regulated self-regulation in Germany are emerging. Cooperative regulation of the state and society is significant and meaningful in regulated self-regulation. In regulatory governance, the state enacts laws, and society sets internal standards. It is being debated whether the norms can be enacted in areas of functional autonomy such as universities and interest groups etc. University rules are one such example. In cooperative legislation based on regulatory governance, it is important to link the private norms to the legal system of the state. The participation of stakeholder, transparency of organization, and acceptance of decisions etc. should be ensured in order to achieve the democratic legitimacy. But for the success of regulated self-regulation, the role and responsibilities of the state are important, and the regulation of the state should be smarter and more rational. New concepts of regulation and regulatory strategies should be established in accordance with changes in the structure of administrative law and the paradigm of regulation.
