초록

본 연구는 경찰법상 일반수권조항에 관한 논의를 법률유보의 관점에서 재조명 하는 것을 목적으로 한다. 본 연구는 경찰법상 일반수권조항에 관한 논의가 독일법의 고유한 역사와 체계를 배경으로 하였을 때에 실천적인 의미를 가지고, 그렇지 않은 우리 법에서는 경찰법상 일반수권조항이라는 특별히 논쟁적인 개념과 체계에 의하지 않더라도 법률유보에 관한 일반이론을 통해서 동일한 결론을 얻을 수 있다는 문제의식에서 출발한다. 독일 경찰법에서는 임무규범과 권한규범을 구별하는 한편으로 일반수권조항을 권한규범의 하나로 인정하는데, 그 논리적인 바탕이 되는 것이 바로 법률유보에 관한 일반이론이다. 우리에게알려진 경찰법상 일반수권조항의 개념과 체계는 법률유보에 관한 일반이론이 독일 경찰법에서 특수하게 발전한 결과인 것이다. 따라서 우리 법에 경찰법상 일반수권조항이 존재하는지 여부에 관한 논의에 앞서 경찰법상 일반수권조항의 개념과 체계를 우리 법의 내재적 요소로 받아들일 것인지에 관한 논의가 선행될 필요가 있다. 경찰법상 일반수권조항의 존재를 부인하는 견해와 경찰법상 일반수권조항의 개념과 체계를 인정하지 않는 견해는 방법론적으로 큰 차이가 있다. 경찰법상 일반수권조항의 개념과 체계는 우리 법의 내재적 요소가 아니라는 것이 본 연구의 결론이다. 다만, 본 연구에서 시도되는 논증은 아직 충분히성숙하지 않으며, 앞으로 계속해서 발전시켜 나갈 계획이다.

영어초록

The purpose of this study is to re - examine the discussion of the general authority clause under the police law perspective on the exclusive delegation doctrine. The consciousness of the problem in this study is that the discussions on the general authority clause under the police law have a practical meaning when it is based on the history and system of the German law. On the other hand, in our law, the same conclusions can be reached through the general theory of legal reservations, even if it is not based on the specially controversial concept and system of the general authority clause under the police law. The German police law distinguishes between the norm of mission and the norm of authority, and recognizes the general authority clause as the norm of authority. The logical basis for this is the general theory of legal reservations.
In other words, the concept and system of the general authority clause under the police law, known to us, is the result of a special development of the exclusive delegation doctrine. under the German police law. Therefore, it is necessary to precede the discussion on whether the concept and system of the general authority clause under the police law should be accepted as an intrinsic element of our law before discussing whether there is a general authority clause under the police law in our law. The view that denies the existence of general authority clause under the police law in our law and the view that does not recognize the concept and system of general authority clause under the police law in our law have a big difference in methodology. The conclusion of this study is that the concept and system of the general authority clause under the police law is not an intrinsic element of our law. However, the arguments that have been tried in this study are not yet mature enough and will continue to be developed in the future.
