무용수를 위한 병역특례제도 개선방안 (A Proposal for Improving Military Service Exemption for Dancers)

초록

본 연구는 병역특혜에 해당하는 예술요원제도의 현황과 복무관리 기준 및 현행 제도 문제점을 문헌적으로 분석하고 예술요원제도 개선에서 진일보하여 무용수를 위한 전반적인 병역특례제도 개선 방안을 제시하고자 하였다. 연구방법은 선행연구 검토 및 문화체육관광부의 정책 현황자료의 직접 수령, 인터넷을 통한 병무청 자료검색과 관련 자료의 전화 확인 그리고 병역특례 관련 신문기사와 인터뷰기사 등을 수집하여 분석에 사용하였다. 그 결과, 다음과 같은 다섯 가지의 남성무용수를 위한 병역특례제도 개선방안을 도출하였다.
첫째, 병역특례기준 대상의 국제대회 참가자에게 지원혜택을 부여한다. 체육의 경우, 국가대표로 선발되면 전폭적인 국가지원 하에 세계대회에 출전한다. 형평성의 측면에서 보면. 신체활동 중단이 직업생명과 문화창달 및 국위선양에 치명적인 무용분야 역시 전국규모의 국내대회 1위 이상의 입상자에게 국가 예산을 지원하는 개선방안이 필요하다.
둘째, 현역입영연기 제한나이를 연장한다. 무용수들이 최고 기량을 발휘할 수 있는 활동 기간은 20대~30대 중반으로 비교적 짧은 편이다. 이에 무용수의 직업 생명주기를 고려하여 현재 입영연기나이를 29세에서 35세로 연장하는 개선 방안을 검토할 필요가 있다.
셋째, 병역특례기준을 국내대회 인정으로 완화한다. 국내 무용경연대회가 국가 인재발굴과 양성에 매우 중요한 견인차 역할을 하고 있다는 점을 감안할 때, 현재 제외되어 있는 발레와 현대무용 분야의 국내대회 1위 입상자 병역특례인정은 국제참가가 어려운 무용계 현실을 반영한 병역특례 내실화 방안이라 할 수 있다.
넷째, 현역복무특례제도로 국군예술부대를 신설한다. 무용은 타 분야와 달리, 전문인력을 수용하는 대체군복무기관이 전혀 없다. 이에 군복무를 수행하면서도 국가의 지원 아래, 무용수가 기량 유지 및 발전하는 장점을 지닌 국군예술부대 신설이 필요하다. 이는 병역기피현상 감소 및 병역특혜시비 최소화 그리고 병역의 형평성과 공익성 축면에서 병역 정책의 효율성을 최대로 상승시킬 수 있는 제도로 판단된다.
다섯째, 사회봉사형태의 재능기부제도를 도입한다. 즉, 예술요원의 특기와 재능을 바탕으로 초등. 중등. 고등학교 및 사회예술취약계층 그리고 경제적으로 취약한 사회적 예술기업, 공연상주예술단체, 문화체육관광부에 등록된 순수예술 개인무용단 등 우리나라 복지증진과 예술 발전을 위해 요구되는 해당분야에서 병역의무이행을 통한 노블레스 오블리주를 실천할 수 있도록 하는 제도적 운영이 필요하다.

영어초록

In this study, we have reviewed in relevant literature the current status of the program for art performers who are eligible for military service exemption and the standard, management, and issues for service, with a view to going from there to suggest a proposal for improving the overall program for military service exemptions. We have adopted study through related literature. And from the combination of researches on earlier studies, policies and status data from Ministry of Culture, Sports, and Tourism, Internet search of the data of Military Manpower Administration, and newspaper articles and interviews on military service exemptions, we have come up with five proposals for improving military service exemptions for male dancers, as follows.
First, eligibility for the program is granted to those who, in accordance with the standard for military service exemptions, are deemed to have participated in international competitions. As for sports, those players who are selected for a national team enjoy full support as they perform in international competitions. Dance can suffer lethal damage from stoppage of bodily activity, so for any fairness, it requires some sort of improvement which would bring state finance to those who come at third or higher in national-level domestic competitions.
Second, the age limit is to be raised for deferment of military service. For their best performance, dancers usually have a short period in their 20s and 30s. So, considering the life cycle of dancers, a proposal needs to consider raising their current age limit at 29 to 35 for deferment of military service.
Third, the standard should be lowered for military service exemptions to recognize record in domestic competitions. Considering that domestic dance competitions spearhead discovery and nurturing of national talents, recognizing for military service exemption those who come first in domestic competitions in ballet and contemporary dance should serve as a method that reflect the reality of dance community in substantiating military service exemptions.
Fourth, a military art program can be created as a military service. Unlike other areas, dance has no military service agency that accommodates specialists in the area. In this light, creating a military art program, which consists in discharging military duty and ensuring maintenance and development of dancer skills, would serve to maximize the efficiency of military service program from the perspective of equitability and public benefit related to military service by discouraging the tendency to dodge military service and diminish controversies around exemptions.
Fifth, talent donation should be adopted as a community service program. Specifically, institutional provision is required to ensure that art performers use their skills and talents to fulfill ‘Noblesse oblige’ by discharging mandatory military service in areas needed for the development of the country’s arts, such as elementary, middle, and high schools, the socially underprivileged, the financially vulnerable social enterprise in arts, residence art performance groups, and individual art dance groups registered with Ministry of Culture, Sports and Tourism.
