초록

최근 대법원은 의사의 의료행위에 주의의무위반을 판단함에 있어서 인과관계 추정의 기준으로 ‘개연성’을 제시한 판결을 선고하였다. 대상판결의 판단은 기존에 우리 대법원이 의사의 의료상 과실 존부를 판단할 때 사용해 왔던 기존의 판례법리와는 다소 결을 달리하는 것이다.
논의의 전제로서 의료과오 증명책임의 완화에 관한 기존 판례법리를 살펴보았다. 하나는 피해자가 의료상의 과실 있는 행위 등을 증명하면 의료상 과실과 결과 사이의 인과관계를 추정하는 방법이고, 또 다른 하나는 피해자가 일정한 간접사실을 증명하면 의료상 과실과 인과관계를 동시에 추정하는 방법이다. 두 법리가 비판받는 지점도 함께 살펴보았다.
대상판결은 기존의 판례법리와 달리 개연성 이론을 도입하여 의료과실과 결과 사이의 인과관계 증명을 완화하였다. 구체적으로 환자 측이 진료 임상의학 분야에서 실행되는 의료수준에서 통상의 의료인에게 요구되는 주의의무의 위반 즉 진료상 과실로 평가되는 행위의 존재를 증명하고, 그 과실이 환자 측의 손해를 발생시킬 ‘개연성’이 있다는 점을 증명하면 진료상 과실과 손해 사이의 인과관계를 추정한다.
대상판결의 타당성을 따져보기 위해 우선 증명책임의 완화이론인 개연성 이론에 대해 살펴보았고, 이어서 대상판결이 환자 측의 증명책임을 경감하여 타당한 결론이라는 점도 확인하였다. 그리고 대상판결 역시 개연성이 갖는 개념의 모호성 등 문제가 없지 않으나, 피해자 보호의 측면에서 개별 사건마다 대상판결과 기존의 판례법리를 유연하게 적용하는 것이 적절하다고 판단된다.

영어초록

Recently, the Supreme Court sentenced a ruling that presented 'probability' as a criterion for determining whether there is a violation of the doctor's duty of care in medical practice. The judgment of the target judgment is somewhat different from the existing case law that the Supreme Court has used to determine the existence of medical negligence of doctors.
As a premise of the discussion, the existing case law on the relaxation of the responsibility for proof of medical errors was examined. One is a method of estimating the causal relationship between medical negligence and outcome when the victim proves a certain indirect fact, and the other is a method of simultaneously estimating medical negligence and causal relationship when the victim proves a certain indirect fact. We also looked at the points where the two laws were criticized.
Unlike the existing case law, the target judgment introduced the theory of probability to mitigate the causal relationship between medical negligence and outcome. Specifically, if the patient proves the existence of a violation of the duty of care required of ordinary medical personnel at the medical level implemented in the field of medical clinical medicine, that is, an act evaluated as medical negligence, and that the negligence is 'probable' to cause damage to the patient, the causal relationship between medical negligence and damage is estimated.
In order to examine the validity of the target judgment, we first looked at the probability theory, which is the theory of easing the burden of proof, and then confirmed that the target judgment was a valid conclusion by reducing the patient's burden of proof. In addition, the target judgment is also problematic, such as the ambiguity of the concept of probability, but it is considered appropriate to flexibly apply the target judgment and existing case law for each individual case in terms of victim protection.
