초록

2020년 수사구조 개혁에 따라 경찰의 수사 자율성과 책임성이 증대됨에 따라 경찰 ‘내사’에 대한 통제를 강화하는 것은 시대정신이라 할 수 있다. 새로운 형사소송법과 대통령령에 따라 종래 학설과 판례에서 인정해 오던 수사기관의 ‘내사’를 명문화하고 종래 내사의 범주에서 활용하였던 ‘피혐의자 수사기관 출석조사’를 한 경우 의무적으로 수사로 전환하도록 하는 등 그 통제를 강화하고 있다. 경찰이 이제는 명실상부한 수사주체성을 인정받은 이 시점에서 ‘내사’ 명칭의 사용 범위를 축소하고 그 성격에 걸맞는 적절하고 충분한 통제 시스템을 갖추는 것이 긴요하다 할 것이다. 그러한 통제장치로서 경찰 내부 수사지휘 및 심사 강화를 위해 도입된 여러 가지 ‘수사’관련 제도들이 ‘내사’에 있어서도 작동될 수 있도록 하고 그 종결의 투명성도 한층 강화될 수 있도록 일부 제도를 개선해 나갈 필요가 있다.

At a time when the police's autonomy and responsibility for investigations have increased due to the reform of the investigative powers in 2020, it can be said that the debate on strengthening the control of the police 'internal investigation' is the spirit of the times. The new Criminal Procedure Act and the Presidential Decree stipulate the 'internal investigation' of the investigative agency, which has been recognized in the theories and precedents, and, in the case of the 'investigation of the attendance of the suspected investigative agency,' which was used in the category of the conventional 'internal investigation', it is mandatory to switch to the investigation procedure. This attempt can be said to be a tendency to strengthen control over the 'internal investigation'. A series of efforts to strengthen internal and external control over the police's “internal investigation” and wash away negative images can be a shortcut to properly revive the purpose of the reform of the power of investigation in 2020.
Now, at this point in which the subjectivity of investigation has been recognized, it is imperative to reduce the scope of use of the name “ internal investigation” and have an adequate and sufficient control system suitable for its nature. As such a control device, internal examination is reinforced, and various systems introduced to strengthen internal investigation direction and screening should be able to be operated in internal investigation as well, and the transparency of the closing can be further strengthened.
