형사소송법상 당사자주의의 연혁과 형사재판의 개선방안 (A Historical Study of the Adversarial System in Criminal Procedure and Its Implications for Criminal Justice Reform)

초록

우리의 근대 형사소송법체계는 1912년 조선형사령에 의한 일본 구형사소송법의 의용으로 서양법체계를 계수하면서 시작되었다. 서양의 대륙법체계가 일본을 통하여 간접적으로 계수된 것이다. 그 뒤 해방 후 형사소송법의 제정과정에서 다양한 영미법적요소가 우리의 형사소송법체계에 도입되었다. 제2차 세계대전 이후 우리나라와 일본에미군정이 실시되면서 미군정의 영향 하에 영미의 형사소송법과 증거법의 요소들이 우리 법체계에 들어온 것이다. 우리나라와 일본 모두 제2차 세계대전 이후 미국법의 강한 영향을 받았고, 일본의 1948년 신형사소송법 제정과정이나 우리나라의 형사소송법제정과정에서 영미법의 영향은 지대한 것이었다. 영미 형사소송의 특색을 이루는 당사자주의와 영미의 대표적인 증거법 원칙인 전문법칙이 이 시기 영미법의 영향으로 우리나라와 일본 형사소송법에 도입되었다.
현행 우리 형사소송법은 전문법칙 및 반대신문권에 관한 규정을 입법함으로써 영미식 당사자주의를 수용하였다. 그 후 여러 차례의 형사소송법 개정과정에서 공판중심주의 또는 당사자주의를 구현하기 위한 제도들이 입법되었다. 본 논문은 영미법상 당사자주의의 연원 및 문제점과 함께 우리 형사소송법상 당사자주의의 연혁을 고찰하고, 영미법에서 기원한 당사자주의의 체계적인 이해를 기초로 우리 형사소송의 구조에 대한 이해를 심화하면서, 실체적 진실발견에 더 효과적인 형사소송절차의 발전 방향을당사자주의와 관련하여 고찰한 것이다.

영어초록

The foundation of Korea’s modern criminal procedure system began with the adoption of Western legal traditions through the application of Japan’s old Criminal Procedure Code under the Chosun Criminal Order of 1912. This marked an indirect reception of the continental legal system via Japan. After Korea’s liberation, various elements of the Anglo-American legal tradition were introduced into our criminal procedure system during the process of enacting the Criminal Procedure Act. Following World War II, both Korea and Japan came under U.S. military administration, during which American criminal procedure and evidence law significantly influenced the development of legal systems in both countries. In particular, the enactment of Japan’s new Criminal Procedure Code in 1948 and Korea’s own Criminal Procedure Act reflected strong influences from Anglo-American law.
Notably, adversarial principles—a hallmark of Anglo-American criminal procedure—were introduced during this period, along with key evidentiary rules such as the hearsay rule. The current Korean Criminal Procedure Act incorporates adversarial principles through provisions on the hearsay rule and cross-examination. Since then, through successive amendments to the law, systems aimed at realizing trial-centered and adversarial proceedings have been legislated.
This paper examines the characteristics, origins, and issues of adversarialism under Anglo-American law, and explores the historical development of adversarial principles in Korean criminal procedure, particularly in relation to the hearsay rule. It also discusses the future direction of Korea’s criminal trials with respect to adversarialism. By developing a systematic understanding of adversarial principles originating in Anglo-American law, this study aims to deepen our understanding of the structure of Korean criminal procedure and ultimately explore more effective directions for a criminal justice system that ensures both procedural efficiency and the discovery of substantive truth.
