개정 형사소송법상 범죄피해자보호 규정에 관한 소고 (A Study on the Criminal Victims Protection Regulations under the Revised Criminal Procedure Act)

2007. 6. 1. 공포되어, 2008. 1. 1.부터 시행하도록 되어 있는 개정 형사소송법은 피의자․피고인의 방어권을 강화하는 여러 제도 및 증거법 체계의 합리적 정비, 실체적 진실규명 기능도 보강하는 한편, 피해자의 형사절차 참여의 촉진, 피해자에 대한 정보제공, 2차 피해자화 예방 규정 및 구속사유 판단시 사안의 중대성 등을 고려하게 하여 국민의 법 감정을 반영하고, 전면 확대되는 재정신청에 대한 남용 방지 대책을 강구하는 등 형사절차의 각 참여자에 대한 균형감각을 잃지 않았다고 보여진다.
따라서 이 논문은 국제적인 인권 기준과 시대적 변화에 적극적으로 부응하는 제도 개혁으로써 개정 형사소송법이 포함하고 있는 범죄피해자 보호규정의 의미와 한계를 외국의 범죄피해자 보호에 관한 법률들과의 비교를 통하여 살펴봄으로써 이에 대한 향후 개선방안을 제시하고자 한다.
우선 피해자 의견진술권을 실질적으로 보장하고, 재정신청의 본래적 취지에 부합하도록 고발사건을 재정신청대상에 포함시키고, 피해자에 대한 정보제공권을 실질적으로 확대하여야 하며, 피고인의 방어권행사를 제한하지 않는 범위에서의 피해자 진술에 대한 비공개 조항이 운용되어야 한다. 또한, 2차 피해자화를 방지하기 위해 형식화된 법조항으로서가 아니라 법 개정의 취지를 담보할 수 있는 실질적 조항으로 기능하도록 형사사법기관의 인식의 전환 및 이를 위한 교육이 실천적으로 선행되어야 할 것이다. 이를 통해 범죄피해자의 실질적인 피해회복을 돕게 됨으로써 형사사법의 이념과 형사절차의 현실을 동시에 만족시킬 수 있는 법률로 자리 잡아 가도록 발전시켜야 한다.

영어초록

It is a matter of fact that criminal victims under the conventional criminal justice system have been recognized both as the objects of means for discovery and those who must cooperate with the investigation agency to help a roundup of criminals, that is, those subject to collection of materials of investigation. For this reason, victims have been neglected from criminal procedure, and their recovery from damage has been slow in progress. Furthermore, criminal victims suffer from criminal victimization itself and bear additional mental anguish due to unconcern of those who are working in criminal justice agencies.
Therefore the revised Criminal Procedure Act, in consideration of the said points, includes several systems to consolidate the rights of defense for suspects and the accused such as counsel's participation in interrogation of suspects, discovery, oral argument, principle of concentrated hearing, change of court structure, etc. On the other hand, functions of the identification of substantial facts have been consolidated such as investigation of video recording, reasonable arrangement of the evidence law system including diversified means to prove establishment of a petition of a protocol, preparation of an interrogatory for a suspect before arrest, video recording of the procedure in a public trial, etc. Moreover, it seems that a sense of proportion is not lost, for example, reflection of people's legal emotion, seeking for measures against misuse of financial application to be extended entirely, in consideration of significance of the case at judgment of the reason for arrest etc.
Thus this study attempts to look into changes in terms of promotion of participation in criminal procedure, consolidation of the right to provide information for victims, and prevention of secondary victimization, and to compare their meanings and limitations with foreign laws on protection of criminal victims with respect to the criminal victims protection regulations that the revised Criminal Procedure Act includes, as institutional reform to positively cope with international human rights standards and periodical changes.
