우버택시와 유상운송금지에 대한 연구 (A Study on Uber Taxi and Prohibition of Commercial Transportation)

초록

ICT에 기인한 정보통신의 발달은 우리사회에 많은 변화를 가져오고 있다. 이러한 현상은 택시업계도 예외는 아니다. 손안에 펼쳐진 스마트 폰 앱상에서 택시에 관한 모든 서비스가 이루어지고 있다. 속도와 규모면에서 가히 혁명적이다. 현재 논란의 중심에 있는 우버택시에 관한 문제도 이러한 혁명의 과정에서 잉태된 산물이다.
인터넷이 세상을 하나로 만들었다면, 스마트폰 앱은 우리들의 일상생활에 깊숙이 들어와 새로운 영역을 개척하고 있다. 새로운 웹 기술들이 속속 등장하면서 삶의 모든 것들이 변하고 있다. 스마트 폰의 세계(P2P)가 펼쳐진 것이다.
2010년 6월 미국 샌프란시스코에서 시작된 우버는 현재 약 76개국 570여개 도시로 진출하는 폭발적인 성장세를 보이고 있다. 우버의 기업가치는 77조원으로 평가된다. 우버가 택시업계에 새로운 지평을 열었음을 알 수 있다. 우버는 보이지 않는 택시에서 보이는 택시로 만들었다. 우버가 제공하는 서비스의 형태는 택시가 나아가야 할 방향을 제시하고 있다.
우버는 소비자의 요구를 반영한 서비스이며, 실제로 소비자 편익을 높이는데 기여하고 있다. 고질적인 승차거부, 불친절, 요금시비, 난폭운전 등이 사라지고 있다. 우버의 바람은 이미 택시업계에 태풍으로 다가와 있다. 우버화(Uberization)는 멈추지 않고 계속해서 세를 불릴 것으로 예상된다. 우버택시에서 시작한 변화는 택시뿐만 아니라 버스, 트럭, 항공, 배달 등으로 범위를 넓혀가고 있다.
우버 운송제국에 대하여 어떻게 대처해야 할까. 택시업계에 떨어진 발등의 불이라 하겠다. 우버가 가세함으로써 승객 유치 경쟁은 갈수록 치열해지고 있다. 이에 따른 기존 택시회사와 이에 소속된 기사들은 생존권의 위협을 받고 있다. 우버를 유상운송금지라는 법적 테두리로 둘러 택시업계를 보호하고 있지만 이는 시간문제일 뿐이다. 우버 혁명은 운수산업의 미래가 되었다. 택시 서비스를 혁명적 수준으로 올려야 하고, 구조조정을 통하여 규모의 경제를 이루어야 할 것이며, 영업형태를 다양화 할 필요가 있다고 본다.
본 논문에서는 우버의 불법성을 근거 짓기 위해 운수사업법상의 유상운송금지규정을 중심으로 하여 우버의 정체성, 요금결정과정, 요금체계상의 문제, 유사유상운송 등을 살펴보도록 한다.

영어초록

The development of information and communication due to ICT has brought many changes to our society. This phenomenon is no exception to the taxi industry. All services related to taxi are being performed on the smart phone app that is open in your hand. It is revolutionary in terms of speed and scale. The issue of Uber taxi, which is at the center of controversy, is the product of the process of this revolution.
If the Internet has made the world as one, smart phone apps are deeply embedded in our everyday lives and pioneering new areas. As new web technologies emerge, everything in life is changing. The world of smart phones (P2P) has spread. This change is an opportunity for some and a crisis for others.
These revolutionary impact that have been brought to the taxi industry have started with Travis Kalanick's Uber. The Uber Service, which started in San Francisco, USA in June 2010, is showing explosive growth at 570 cities in 76 countries. Uber's corporate value is estimated 77 trillion won. It can be seen that Uber has opened up a new dimension to the taxi industry. The Uber Service turned invisible taxi into visible taxi. The type of service Uber provides suggests directions for taxis industry to proceed.
The Uber is a service that reflects the needs of consumers and is actually contributing to consumer convenience. Unreasonable riding refusal, unkindness, issue of fare, reckless driving are disappearing. Uber wind is already approaching the taxi industry as a typhoon. Uberization is expected to continue to grow without stopping. The changes that began in the Uber-Taxi is widening to the scope of buses, trucks, aviation, delivery.
How should we cope with the Uber transport empire? It is a big problem to be solved by the taxi industry. The competition for attracting passengers is becoming more and more intense as Uber joins. As a result, existing taxi companies and their drivers are threatened with the right to survive. Although the taxi industry is being protected from the Uber service by prohibition of commercial transportation but it is only a matter of time. The Uber Revolution became the future of the transportation industry. It is necessary to raise the taxi service to a revolutionary level, to make the economy of adequate scale through restructuring, and to diversify the business form.
In this paper, we investigate Uber's identity, charge determination process, problem of charge system, and similar commercial transportation based on prohibition of commercial transportation in Passenger Transport Service Act to find reason of Uber's illegality.
