초록

정권의 속성에 의한 사회보장법 형성의 특징은, 민간정권의 기초적 생성단계, 군사정권의 명목적 제정단계, 민주정권의 규범적 정비단계 등 3단계로 구분되어 드러난다고 할 수 있다. 사회보장법 형성구조의 풍토적 특징은 i) 국민저항과 집권세력 대응의 정치적 산물인 사회보장입법이 ii) 사회보장지향 전문집단의 연속적인 헌신적 노력으로 제정되지만 iii) 경제우선주의와 비용부담 및 전달체계 취약구조로 인해 명목적 편의규정에 머물다가 iv) 1987년 헌법(민주정치와 경제성장의 동반결실) 이후 시민혁명의 요구에 대응하여 단계적으로 규범적 실효성을 확보하게 된 것이라고 보는 것이 타당하다고 본다. 이러한 특징을 압축하여 사회보장입법은 ‘전문 집단 헌신 주도 속의 국민저항과 집권층 대응의 정치적 산물’이라는 그 형성의 추론원리를 제시할 수 있을 것이다. 또한 법사상적 관점에서 본다면 사회보장법 형성과정을, 제헌 헌법의 정신 즉 사회민주주의를 기초로 한 ‘국민이익균점’사상의 부활과정으로 파악할 수 있는 특징이 있다. 이 같은 법형성의 추론원리를 밑바탕으로 하고 사회보장입법의 실질적 규범성 여부를 판단기준으로 삼아 법형성의 특징을 검토하면 다음과 같은 결론에 이르게 된다. 첫째, 5⋅16 군사정권은 실제로 사회보장법을 실현할 정책적 의지가 없었다는 점이다. 둘째, 경제성장보다는 오히려 정치민주화가 규범적 사회보장법형성의 관건으로 작용했다는 것을 지적 할 수 있다. 셋째, 법제정의 명목적 편의성의 원인은 사회경제적 기초여건의 결여 못지않게 정책결정자의 인식부족에서 비롯된 것이 많음을 알 수 있다. 넷째, 사회보장운동세력(사회보장심의위원 등을 중심으로 한 전문 집단)의 헌신적 노력이 사회보장법형성의 기틀이 된 점을 높이 평가하여야 한다. 근본적으로 사회보장법의 형성은 정치민주화를 향한 기층세력의 저항과 경제성장을 위한 노동계층의 희생 그리고 사회보장추진 전문집단의 헌신이 기초가 된 ‘통합관계의 연속적 개혁 흐름’의 결정체로 보아야 할 것이다.

영어초록

Looking back at the history of social security law formation in South Korea, the process was largely dependent on the vicissitudes of the ruling party. Each stage of its development could be labeled in three consecutive periods, respectively : (1) the basic formation period (conceived in a period of ordeals), (2) the nominal legislative period during the military regime (the deformative birth period), and (3) the substantive implementation period (normalization of social security law with the establishment of democratic government). The cultural and historical characteristics of the formation process of social security law in South Korea could be summarized as : “i) The body of social security law, which is the political result of the dynamics between people’s resistance and governmental response, ii) was legislated based on the continuous effort of expert groups who recognized the importance of social security system, but iii) the laws remained only as a formality because of the unbalanced focus on economic growth, lack of budget and adequate communication. iv) The laws finally came into life after the 1987 Constitutional amendment (which was the fruit of development of democracy and economic growth), which reflected the demands from the civil revolution. From these characteristics, a principle of social security law is derived; that is, “Korean social security law is a political result of the struggles between people’s resistance and governmental response, led by devoted expert group.” In addition, when viewed from legal philosophy perspective, the process of social security law formation could be understood as a revival of the spirit of the Founding Constitution of Korea - which is ‘equality of profit sharing’ based on social democracy. Based on this legal formation principle, and analyzing the actual effectiveness of social security legislation, the following four propositions are derived. First, the May 16 military regime had no genuine intent to actually implement social security law into reality. Second, it was the democratization of politics, rather than economic growth, which truly contributed to the substantive formation of social security law. Third, the nominal legislation during the military regime was due to not only the lack of basic social and economic infra-structure, but also due to the lack of a correct understanding of social security law of the policy makers. Last but not least, a continuous effort by a small number of expert groups who were devoted to establishing social security system was the true bedrock of social security law formation; their effort deserves a special tribute.
In conclusion, the formation of social security law in South Korea was a crystallization of a ‘integrated, continuous movement toward reform’ which was born and grown within the dynamics of People’s resistance for democracy and the governmental response to it, that was given life by the devoted expert group who led the social security movement.
