건전한 성풍속 및 성도덕에 관한 일 고찰 (A Review on the Sound Sexual Customs and Sexual Morality)

초록

“건전한 성풍속 및 성도덕”은 성(性)에 관한 법과 제도의 정당성을 논할 때 흔히 등장하는 관념이다. 하지만 그것에 대하여는 고정된 실체가 없 다, 판단기준이 분명하지 않다, 불합리한 감정에 기초한다는 등 많은 비 판이 제기되어 왔다. 이 연구는 그것이 지시할 수 있는 대상들과 그에 따 라 가질 수 있는 의의들 중 일부를 하트-데블린 논쟁의 한 당사자인 데블 린(P. Devlin)의 생각과 그의 생각을 보완하거나 수정한 이론들을 검토해 서 고찰한다.
“사회를 유지하기 위해서 사회도덕을 법으로 강제할 수 있다”는 데블 린의 주장은 영국 뿐 아니라 다른 나라에서도 사법부의 공통된 신념을 이 루고 있는 것으로 보인다. 법과 사회도덕이 수렴할 것이 요청되기 때문이 다. 그러나 이런 생각은 사회도덕의 변화가능성을 적극적으로 수용하기 어렵고, 어떤 사회도덕이 나쁠 가능성이 있고, 대중의 불합리한 감정에 기초해서 억압적이고 소수자를 부당하게 차별할 위험이 있다는 비판을 받는다.
데블린의 이론을 공동체주의적으로 재해석하면, 어떤 사회의 관행도덕 은 그 사회의 구성원들이 같이 헌신해서 사회적 통합을 이루고 공통의 정 체성을 확보할 수 있게 하므로 법으로 유지할 만한 가치가 있다고 할 수 있다. 이런 구성은 “사회도덕이 무너지면 사회가 해체된다”고 하는 그의 주장을 더 설득력 있게 하지만, 나쁜 사회도덕이 있을 가능성과 대중의 감정이 불합리할 위험은 여전히 해소하지 못 한다.
존 킥스(J. Kekes)는 데블린의 사회해체 테제와 “불관용, 분노, 혐오 없 이는 어떤 사회도 존속할 수 없다”는 주장을 수용해서 도덕의 법적 강제 가 정당한 범위와 도덕적으로 정당한 혐오에 관하여 독자적인 이론을 보 였다. 그는 문명사회에 보편적이고 필수적인 도덕규칙들은 법으로 강제 하는 것이 정당하고, 그런 규칙들을 위반하는 행위 중 일부에 대한 깊은 혐오는 합리적이고 도덕적으로 정당하다고 주장하였다.
이런 고찰을 기초로 해서, “해악 없이는 범죄 없다”고 하는 자유주의 형법이론의 구호가 타당하지 않은 행위들이 있으며, 어떤 사회의 확고한 도덕적 정체성을 이루고 있는 형법규범의 변경에는 신중할 필요가 있다 는 결론을 도출할 수 있다.

영어초록

“Sound sexual customs and sexual morality” is a notion frequently invoked in discussions about the legitimacy of laws and institutions related to sex. However, there have been many criticisms about it, including the ones that it has no fixed substance, that the criteria for judgment are uncertain, that it is based on irrational emotions and so on. This study looks at some of the objects it may indicate and the implications it may have by examining the ideas of P. Devlin, a party to the Hart-Devlin debate, and theories that supplement or modify his ideas.
Devlin’s assertion that “social morality can be enforced by law in order to maintain the society” seems to form a common belief of the judiciary not only in England but also in other countries. This is because law and social morality are required to converge. However, this idea has been criticized that it makes it difficult to actively accept the possibility of changes in social morality, that some social morality may be morally wrong, and that there is a risk of oppression and unfair discrimination against minorities based on unreasonable feelings of the public.
Reinterpreting Devlin’s theory in a communitarian way, it can be said that the customary morality of a society is worth protection by law as it enables members of that society to commit themselves together to achieve social integration and secure a common identity. This interpretation makes his argument that “if social morality collapses, the society disintegrates” more convincing, but still does not resolve the issues of the possibility of bad social morality and the risk of unreasonable public feelings.
J. Kekes, accepting Devlin’s thesis of social disintegration and the claim that “No society can do without intolerance, indignation, and disgust”, proposed his own theory of the enforcement of morality. He argued that the moral rules that are universal and essential to a civilized society should be enforced by law, and that the deep disgust of some of the acts that violate those rules is rational and morally just.
Based on these considerations, this study concludes by suggesting that there are some harmless wrongdoings which can be legitimately prohibited by criminal law, and that we should be cautious in changing the criminal law which constitutes a firm moral identity of a society.
