소극적 권리범위확인심판에서 속함(침해) 또는 속하지 않음(비침해)의 증명책임의 소재 (In a Negative Right Scope Declaration Trial, the Burden of Proof of Belonging (infringement) or Non-belonging (non-infringement))

초록

본 논문은 소극적 권리범위확인심판에서의 증명책임의 분배에 대해 논한다. 일반 민사소송에서 증명책임 분배의 다수설인 법률요건분류설과 대법원 판례에 의하면 권리부존재의 확인소송, 청구이의의 소, 배당이의의 소에서 원고(채무자)가 해당 사실의 부존재를 주장하기만 하면, 피고(채권자)가 해당 사실의 존재를 증명하여야 한다. 이러한 증명책임의 분배원칙을 소극적 권리범위확인심판에 적용하면 청구인(침해염려자)이 속하지 않음(비침해)의 사실을 주장하기만 하면, 피청구인(특허권자)이 속함(침해)의 사실을 증명해야 할 것으로 보인다. 그러나, 특허법원의 2016허4818 판결 및 2006허2295 판결은 소극적 권리범위확인심판의 청구인이 속하지 않음(비침해)의 사실을 증명해야 한다고 설시하였다. 이 글은 그 두 판결이 타당한지 여부를 검토하는 것을 목적으로 삼았다. 이와 관련하여 중국, 오스트리아, 미국, 독일, 영국, 일본 및 한국의 법리를 비교법적으로 분석하였고, 그러한 분석을 통하여 다음과 같은 결론을 도출하였다. 첫째, 소극적 권리범위확인심판에서의 확정심결이 진정한 확정성(finality)을 가지기 위해서는 소극적 권리범위확인심판에서도 권리자(피청구인)가 청구인이 특정한 확인대상이 권리범위에 속함(침해)을 증명하는 것이 타당하다. 둘째, 권리자가 문언침해의 증명에 실패하여 균등침해를 주장하는 경우, 균등침해 판단기준의 5가지 요소 중 적극적 요건에 해당하는 3가지 요소에 대하여는 권리자가 증명책임을 부담하고 소극적 요건에 해당하는 균등 4요소와 균등 5요소에 대하여는 소극적 권리범위확인심판의 청구인이 증명책임을 부담하는 것이 타당하다.

영어초록

This paper discusses the distribution of burden of proof in a negative right scope declaration trial. According to the majority theory of the distribution of burden of proof in general civil litigation, the theory of classification of legal requirements, and the Supreme Court precedents, if the plaintiff (debtor) asserts the nonexistence of the relevant fact in a lawsuit for declaration of nonexistence of a right, a lawsuit for objection to a claim, or a lawsuit for objection to distribution, the defendant (creditor) must prove the existence of the relevant fact. If this principle of distribution of burden of proof is applied to a negative right scope declaration trial, it seems that if the claimant (the person concerned with infringement) asserts the fact of non-infringement, the defendant (patentee) will have to prove the fact of infringement. However, the Patent Court’s 2016Heo4818 and 2006Heo2295 decisions stated that the claimant in a negative right scope declaration trial must prove the fact of non-infringement. This paper aims to examine whether the two judgments are valid. In this regard, the legal theories of China, Austria, the United States, Germany, the United Kingdom, Japan, and Korea were comparatively analyzed, and the following conclusions were drawn through such analysis. First, in order for the final judgment in a negative right scope declaration trial to have real finality, it is reasonable for the right holder (the defendant) to prove that the specific subject matter of declaration falls within the scope of the right (infringement) in the negative right scope declaration trial. Second, in cases where the right holder fails to prove literal infringement and asserts equivalent infringement, it is reasonable for the right holder, who is the defendant in the negative right scope declaration trial, to bear the burden of proof for first three of the five elements corresponding to the positive requirements of the equivalent infringement judgment criteria, and for the claimant in the negative right scope declaration trial to bear the burden of proof for the equivalent fourth and fifth elements corresponding to the negative requirements.
