일본에서의 디지털플랫폼의 투명화와 소비자보호 (Transparency and Consumer Protection of Digital Platform in Japan)

초록

일본은 디지털플랫폼에 있어서 거래의 투명성과 공정성의 향상을 꾀하기 위하여 「特定デジタ ルプラットフォームの透明性及び公正性の向上に関する法律(특정디지털플랫폼의 투명성 및 공정성의 향상에 관한 법률)」을 시행(2021년 2월 1일)하고 있다. 특정디지털플랫폼거래투명화법에서는디지털플랫폼제공자에 대하여 거래조건 등의 정보의 개시, 운영에 있어서 공정성 확보, 운영상황의 보고의 의무화, 평가⋅평가결과의 공표 등의 필요한 조치를 강구한다. 또한, 시책의 실시에있어서는 디지털플랫폼제공자의 자주적이고 적극적인 대처를 기본으로 국가의 관여 등을 필요최소한의 것으로서, 디지털플랫폼제공자와 디지털플랫폼을 이용하는 거래처 사업자와의 사이의 거래관계에 있어서 상호이해의 촉진을 도모하여야 하는 것으로 하였다.
또한 소비자 피해 증가가 우려됨에 따라 디지털플랫폼에서의 상거래에 관하여 소비자를 보호하는 것을 목적으로 「取引デジタルプラットフォームを利用する消費者の利益の保護に関する法律(거래 디지털플랫폼을 이용하는 소비자의 이익의 보호에 관한 법률)」을 시행(2022년 5월 1일)하고있다. 거래디지털플랫폼소비자보호법에서는 거래디지털플랫폼제공자의 노력의무, 상품 등의출품정지 등의 요청, 판매업자 등 정보의 개시청구, 거래디지털플랫폼 관민협의회의 설치, 소비자 신고제도 등을 주요 내용으로 하고 있다.

영어초록

Aiming to improve the transparency and fairness of digital platforms, the Act on Improving Transparency and Fairness of Digital Platforms (TFDPA) was established on May 27, 2020, promulgated on June 3, 2020, and enforced on February 1, 2021.
The Act stipulates necessary measures for digital platforms, including requirements of digital platform providers to disclose terms and conditions and other information, secure fairness in operating digital platforms, submit a yearly report on the current situation of business operation, and conduct self-assessments. The Act also requires the METI Minister to review the business operation of the platform based on the yearly report and other information with involvement of business users, consumers and academics, and to publish the results of the assessment. In addition, the Act requires the government to encourage digital platform providers and their customers to facilitate mutual understanding on the basis of such digital platform providers making voluntary and proactive efforts with minimally necessary commitments by the government.
Aiming to promote the adequacy of transactions related to mail-order sales and the resolution of disputes using the transaction digital platform, the Act on the Protection of Consumers Who Use Digital Platforms for Shopping (PCDPA) was established on April 28, 2021, promulgated on May 10, 2021, and enforced on May 1, 2022. The Act obliges digital platform providers to ease communications between sellers and buyers on their platforms, initiate investigations if complaints are made and do identity checks of sellers as necessary. Listings of unsafe products must be removed if the seller is difficult to identify. Further, consumers have the right to request seller information when it comes to making claims for damages against sellers. The Act also holds that a public-private council of national government agencies and digital platforms is to be established in order to discuss issues arising in the area of digital platforms. The council must also establish a reporting system, where consumers can report risks to the Consumer Affairs Agency and request that appropriate measures are taken in response.
