중국의 금융소비자 보호 입법동향에 관한 연구 (Recent Legislative Trend in Financial Consumer Protection of China)

초록

금융산업의 발전과 더불어 금융상품이 점차 복잡해지고 다양화되면서 금융소비자보호의 문제도 사회적인 이슈로 부각되었는데, 이에 따라 2000년을 전후로 하여 미국과 영국 등 세계주요 국가들은 금융소비자보호를 위해 관련법규를 통합적으로 정비하기 시작하였다. 한국에서는 지난 6여 년 동안 발의와 폐기를 반복한 금융소비자보호법이 현재 국회에 계류 중이다. 법안은 집단소송 및 징벌적 손해배상제도 등 규정을 신설하여 금융소비자보호의 국제적 추세에 부응하려는 경향을 보여 주고 있다. 반면에 유감스럽게 중국에서는 이러한 입법 움직임이 아직 없기 때문에 금융소비자보호법이 언제 제정될 지는 미지수다. 중국의 금융소비자보호제도는 아직 정책성 수준에 머물러 있는 초급 단계라고 할 수 있기 때문에 금융선진국에 비해 상당한 거리가 있다는 점을 시인하지 않을 수 없다. 다행히 2014년 3월 15일부터 실시된 신 「소비자권익보호법」은 금융소비자를 보호범위 안에 포함시켜 중요한 의의를 갖게 되었다. 그리고 최근에 와서도 이러한 노력이 지속되고 있다. 즉 2015년 11월 13일 국무원판공청이 「금융소비자권익 보호 사업을 강화할 데 관한 지도의견(关于加强金融消费者权益保护工作的指导意见)」(이하 ‘지도의견’)을 공포하고, 2016년 12월 27일 중국인민은행이 「금융소비자 권익보호의 실시방법」(金融消费者权益保护实施办法)(이하 ‘방법)을 공포하였다.
본 논문은 한중 양국 금융 분쟁의 현실에 입각하여 금융소비자보호의 필요성과 의의를 감안하면서 중국 최근 금융소비자 보호 입법동향을 고찰하고 금융소비자보호에서 존재하는 문제점과 미비점을 검토하고 향후 발전방향을 제시하고자 한다. 특히 한국 금융소비자보호의 법적 제도 및 입법경험이 가져다주는 시사점으로부터 향후 중국 금융소비자 보호에 관한 법체계의 정립을 위한 방안을 모색하는데 착안점을 두었다.

영어초록

As the financial products grew increasingly complex and diversified, financial consumer protection issues emerged as a social issue, and in the aftermath of 2000, the United States and Britain began to consolidate related laws to protect financial consumers. In the past six years, the Finance and Consumer Protection Act, which repeated the movement and abolition of the ban, is currently pending in the National Assembly. The bill shows a tendency to meet the international trend of protection of financial consumer by establishing regulations such as class-action lawsuits and punitive damages. Regrettably, however, there is no doubt that the legislation will be enacted anytime because there is no such legislation in China. One should not overlook the fact that China's financial consumer protection system is still far from financial advanced countries, as it is still a beginner at the level of staying afloat. Fortunately, the new “Consumer Rights Protection Act”, launched on March 15, 2014, has gained important significance by incorporating financial consumers into protective areas. And recently, these efforts continue to exist. On November 13, 2015, the State Council General Office issued a guideline to protect the rights of consumers who bought financial products and services, and regulate and guide the services of financial institutions. On December 27, 2016 the People's Bank of China issued the measures for the implementation of protecting the rights of consumers who bought financial products and services.
Based on the realities and significance of the financial dispute between Korea and China, this paper aims to review the trends and implications of financial consumer protection in consideration of the needs and problems of the financial consumer protection, to review future developments of the financial consumer protection in China. In particular, it pointed out that it seeks to devise ways to establish a legal framework for Chinese financial consumer protection institutions in the future from the legal system and legislative experience of Korean financial consumer protection.
