초록

발전소 주변지역 주민을 지원하기 위하여 『발전소 주변지역 지원에 관한 법률』(이하 발주법으로 약칭한다)이 제정되어 있다. 동법은 발전소의 주변지역에 대한 지원사업을 효율적으로 추진하고 전략사업에 대한 국민의 이해를 증진하여 전원개발을 촉진하고 발전소의 원활한 운영을 도모하여 지역발전에 기여함을 입법목적으로 하고 있다.
입법목적을 발전소 소재 지역 주민입장에서 보면, 지원사업을 통한 지역발전이 목적인 것이다. 현행 발주법에 의하면, 지원사업은 발전기가 설치되어 있거나 설치될 지점으로부터 반지름 5킬로미터 이내의 육지 및 섬지역이 속하는 읍․면․동으로 한정하고 있다(발주법 제2조). 지원사업의 종류는 기본지원사업, 특별지원사업, 홍보사업, 그 밖에 주변지역의 발전, 환경․안전관리와 전원 개발의 촉진을 위하여 필요한 사업 등이 있다(발주법 제10조). 발주법상 기본지원사업은 발전소 건립 시작부터 발전소가 가동 종료될 때까지 매년 발전소 주변지역에 지원하는 사업이다. 반면에 특별지원사업은 발전소가 건설중이거나 건설이 예정된 주변지역과 그 특별자치도․시․군․구 및 자치구(이하 지방자치단체라 한다)에 대하여 시행하는 일시적인 지원사업이다. 발전소 소재 반경 5킬로미터 뿐 만 아니라 해당 자치단체 전체를 위하여 할 수 있는 사업이다. 이러한 점 때문에 발전소가 직접 들어서는 주민과는 갈등의 소지가 있다. 물론 해당 지역주민들의 충분한 의견수렴과 소통이 있다면 큰 문제가 아니다. 그러나 현행 법제도상의 문제점을 포함하여, 현장에서는 그렇지 못하다. 그래서 해당 지역 주민들과의 갈등이 존재한다.
이 연구는 발전소가 건립되는 지역 주민들과 지역전문가·교사들의 인식을 조사하여 현행 제도가 무엇이 문제인지, 법정책적 시사점을 찾아 발주법상 지원사업의 발전방안을 모색하고자 한다. 다만, 전국적으로 발전소가 소재하는 지역이 많고, 지역마다 사정 또한 다르다. 모든 지역의 주민들의 인식조사를 통한 연구가 바람직하지만, 시간적, 경제적 여건의 한계로 말미암아 경기도 포천시 소재 포천복합화력발전소로 한정하고자 한다. 이 연구는 전국 발전소 주변지역 전체를 포괄할 수는 없지만, 발전소 주변지역 주민들의 일부 실증적 인식은 찾아 볼 수 있을 것이다.
결론적으로 발전소 주변지역 지원사업의 발전방안과 연구작업을 다음과 같이 제시하고 있다. 첫째, 공공갈등관리의 제도화이다. 둘째, 지방차원에서의 상호신뢰와 민주적 참여를 통한 소통과 합의의 과정을 통해 갈등을 해소하는 사회적 자본 증진시스템으로서의 민주적 로컬거버넌스 체제의 조기 구축작업이다. 셋째, 지역주민에게 혜택이 돌아갈 수 있는 방안을 모색하기 위해서는 신개념의 지역주민 지원사업 모델구축 작업의 필요성을 제시하고 있다.

영어초록

The Act on Assistance to Electric Power Plants-Neighboring Areas (AAEPP) is established to support residents around power plants. The purpose of this Act is to promote the development of electric power resources, strive for the harmonious operation of electric power plants and contribute to regional development by efficiently carrying out assistance programs to the neighboring areas of electric power plants and raising public awareness of electric power business.
From the residents' perspective, the primary purpose of this Act is to promote regional development through assistance programs. According to this Act, the assistance programs are confined to the area of a Eup/Myeon/Dong, which includes the land and island located within five kilometer radius from the location where an electric generator of an electric power plant is already installed or to be installed (AAEPP Article 2). The kind of assistance programs is basic assistance, special assistance, public relations, and other programs that are necessary for the development of the neighboring area, its environment and security management, and the advancement of the development of electric power resources (AAEPP Article 10). The basic assistance is an annual program that is aimed at developing neighboring areas of the power plant, which begins from the construction of a power plant till the suspension of an operating power plant. However, the special assistance is a temporary program for a neighboring area where an electric power plant is being constructed or prearranged to be constructed and areas of the relevant Special Self-Governing Province, Si, Gun and autonomous Gu (hereinafter referred to as "local government"). Therefore, it not only assists the neighboring area within five kilometer radius but also supports local government. This difference in legislation and programs creates conflicts for residents about the power plant construction. This, of course, may not be a major problem when a broad variety of opinions from the residents are considered. However, inadequate communication along with the problems of the current legislation during the process of power plant construction is widely seen as a serious issue in reality. Thus, there is constant conflict within this system.
This research scrutinizes the existing problem of the legal system and suggests its legal policy implications and its development plan through an awareness investigation of residents, experts, and teachers in the region around the power plant. Nevertheless, power plants are operating in various places across the country. Although it is ideal to analyze all of the regions, this research focuses only on Pocheon Combined Cycle Power Plant in Pocheon, Gyeonggi-do because of economic and time factors. Thus, this research at least provides some empirical recognition of the people around the power plant.
Lastly, the enhancement strategies are as follows.
First, public conflict management should be institutionalized. Secondly, an early establishment of democratic local governance system, which promotes social capital and settles conflicts through mutual trust and democratic participation at local level, is necessary. Lastly, a new concept of assistance program model should be constructed to benefit residents around the power plant.
