소비자 제품 안전법제의 개선을 위한 고찰 - 미국과 호주의 소비자 안전법제와의 비교법적 고찰을 중심으로 - (A Study for the Improvement of Consumer Product Safety Legislation - Focusing on the comparative legal research of consumer safety legislation in the United States and Australia -)

초록

이 글은 우리나라의 소비자 제품 안전법제의 개선을 위하여 미국과 호주의 소비자 제품 안전법제의 특성을 개관하고 입법례를 살펴보면서 비교법적 시사점을 도출하고자 한 글이다. 우리나라의 소비자 정책은 1980년 「소비자보호법」이 제정된 이래, 여러 법규들이 신설되고, 소비자 정책에 대한 조직이 신설되며 성장해 오며 발전하였다. 2008년에 이르러 소비자 정책은 성숙기를맞고 소비자 안전관리체계의 강화를 위한 여러 법규들이 제정되었으나 주무부처가 나뉘어 있어서 기관 간의 협조가 필요하기에 발 빠른 대처가 어려울 수 있다는 점이 지적되고 있다, 리콜제도에 있어서도 소비자 위해정보국의 출범으로 활발하게 활동하고는 있으나, 손쉽고 빠르게 리콜을 받을 수 있도록 리콜제도에 대한 홍보 및 보다 적극적인 활용이 필요하다. 인공지능과 빅 데이터의 시대, 이미 수많은 제품이 제조 및 유통되고 있으며, 소비자 제품에 대한 기술의 발전도인류 역사상 가장 빠르게 이루어지고 있다. 소비자 제품은 그 특성상 빠른 소비속도 만큼, 제품에 의한 피해의 발생속도도 대응 속도보다 빠를 수 있기에 피해의 예방을 위해서라도 소비자 제품의 안전관리와 그와 관련한 법적 체계의 정비가 절실한 시점이다. 이와 같은 견지에서, 1970 년대부터 50여 년간 소비자 보호를 위하여 입법과 제도를 개선해 온 미국의 CPSC와 그와 관련된 개별 법규, CPSC 외의 연방 소비자 제품 안전 관리 법규와 관련 기관들을 살펴보며, 소비자제품에 대한 안전 관리에 대한 이해를 높이고 미국에서의 자발적 리콜 제도의 선순환 구조에 대해서도 소개하고자 한다. 아울러, 우리와 함께 아시아-태평양 지역의 무역 및 투자의 연결고리로이어져 있는 호주의 2019년 소비자안전시스템의 법제 개혁 특징 등을 통하여 앞으로 우리의 소비자 안전법제는 어떤 방향으로 개선되어야 할 것인지 고찰해 보았다.

영어초록

To clarify the direction of improvement of Korea’s consumer product safety legislation, this study aims to outline the characteristics of consumer product safety legislation in the US and Australia and derive comparative legal implications by examining legislation. Since the enactment of the Consumer Protection Act in 1980, Korea’s consumer policy has developed as various Acts and regulations have been established, and an organization for consumer policy has been newly established.
As the Korea Consumer Agency (KCA) organized its general department into the Fair Trade Commission in 2008, various laws were enacted to strengthen the consumer safety management system at maturity, but it may be difficult to respond quickly because the competent ministries’need cooperation. In terms of the recall system, Consumer Injury Surveillance System (CISS) has been launched and is actively working, but it does not give consumers the perception that they can receive recalls easily and quickly. In 2023, numerous products are being manufactured and distributed, and the development of technologies for consumer products has also accelerated. As consumer products are fast in consumption due to their nature, the speed of damage caused by products can be faster than the speed of process, so it is urgent to improve the safety management of consumer products and related legal systems.
From this point of view, the CPSC, which has improved legislation and institutions to protect consumer products since the 1970s, and related laws and regulations, as well as federal consumer product safety management laws other than CPSC, were introduced. It introduces understanding of Consumer Products Safety Management System in U.S., introduces that voluntary recalls are activated through the federal government’s integrated recall information site (Recalls.gov), and provides implications for our consumer product safety legislation through a virtuous cycle of voluntary recalls and cooperation between the federal government and consumer safety agencies. In addition, by looking at Australia’s consumer product safety legislation (ACCC), which leads to trade and investment links in the Asia-Pacific region, we tried to derive comparative implications for data analysis through the OECD recall portal.
