초록

본 연구는 아파트 가격정보가 공격적 납세자의 증여세 신고수준에 미치는 효과를 분석한 실증연구이다.
우선, 공시가격, 유사매매사례가액 및 세금절감액과 공격적 납세자의 증여세 신고수준과의 상관관계를 분석하였다. 다음으로, 아파트 매매사례가액의 공개가 공격적 납세자의 증여세 신고수준에 미치는 영향을 분석하기 위해 장․단기 사건 분석을 실시하였다. 가설 검정을 위해 표본 보정과 함께 양측 회귀분석을 실시하였다. 그리고 분석을 위해 2005년 8월부터 2008년 8월까지 과세불복 사건을 조사하여 197개 표본을 사용하였다. 분석 결과, 예측한 바와 같이 공시가격, 매매사례가액 및 세금절감액은 증여세 신고수준에 유의하게 영향을 미치는 것으로 나타났다.
주변 유사 아파트의 매매사례가액의 공개의 정보 효과에 대한 사건연구 결과, 단기적으로 그 효과가 일관성을 유지하지 못하였으나, 장기적으로는 그 효과가 유의한 것으로 분석되어, 아파트 매매사례가액 정보공개 효과는 상당한 시차를 두고나타나고 있음을 발견하였다.
이러한 결과의 주된 원인은 아파트 매매사례가격 공개의 불완전성과 세금절감을 기대한 납세자의 공격적인 세무신고의 상호작용 효과에 기인하는 것으로 분석된다. 본 연구는 아파트 매매사례가액 공개가 납세자의 신고수준에 미치는 영향을분석한 첫 실증연구로서, 특히 모호한 과세규정과 비대칭적 정보구조 내지는 불확실한 정보상황하에서 매매사례가액 공개를 통하여 과세불복을 줄이고 신고수준을높일 수 있는 실증적 근거를 제공하였다. 나아가, 본 연구 결과는 조세입법정책과행정 개선에 있어서 유익한 정책적 시사점을 제공할 것으로 기대된다.

영어초록

This is an empirical study of how information on the traded value of apartment units affect aggressive taxpayers' compliance behavior in declaring gift and inheritance tax. This study first analyzes the correlation between the apartment unit's declared value, market value (i.e., value at which an apartment unit of similar worth was traded on the market), and the amount of tax savings；and the amount of gift and inheritance tax declared by a taxpayer. Next, it examines actual instances to analyze how the availability of market values affect a taxpayer's declared amount of gift and inheritance tax. A two tailed test was performed to examine the assumption. For this purpose, 197 tax appeals cases filed between August 2005 and December 2008 were sampled.
Consistent with initial assumptions, the result showed that declared value,market value, and tax savings amount had a statistically significant impact on the level of reported gift and inheritance tax. Further examination was conducted to identify the relationship between the release of market value of apartment units having similar property value located in nearby areas. Findings show no consistent trend in the short term, but show a significant pattern in the long term, indicating a significant time lag between the release of market values and the amount of declared gift and inheritance taxes. This is most likely the result of an interaction between the incompleteness of the information released and taxpayer expectations for aggressive tax savings. This is the first empirical study that examines the impact public releasing of market value has on the level of gift and inheritance tax declaration. The study provides empirical evidence on how, under circumstances where tax regulations lack clarity, information provision is asymetrical, and information is incomplete, the release of market value of apartment units can help reduce tax appeals and enhance taxpayer compliance. Furthermore,the results of the study provides an important implication for those seeking to improve tax policy and administration.
