초록

이 글은 중국의 시장경제지위(Market Economy Status) 인정을 둘러싼 미·중 간 분쟁을 세력전이론의 관점에서 분석하는 것을 목적으로 한다. 중국은 1978년 개혁개방을 통해 시장경제 요소의 도입으로 산업화와 경제발전을 추진하고, GATT에 이어 WTO 가입을 적극 추진해왔다. 그러나 시장경제를 전제로 설립된 WTO의 비시장경제에 관한 제도적 미비는 2001년 중국의 가입 의정서에 규정된 15년의 체제전환 유예기간이 종료되는 시점인 2016년을 전후로 예상된 분쟁 발생의 원인을 제공했다.
중국은 2016년 12월 이후 대체국 제도의 중지와 시장경제지위의 자동획득을 주장하고, 동 지위의 인정과 반덤핑 관세 산정에 중국의 국내 가격을 사용할 것을 EU와 미국에 촉구해왔으나 미국은 중국의 체제전환 정도가 불충분할뿐만 아니라 오히려 역행하고 있으므로 중국은 여전히 비시장경제이며 따라서 시장경제지위를 인정할 수 없다고 주장한다.
시장경제지위를 둘러싼 미·중 간의 분쟁은 단순한 조항의 해석이나 경제적 득실을 넘어 체제 정체성과 발전모델 및 글로벌 거버넌스를 둘러싼 기존 강대국과 신흥 강대국 간 세력경쟁의 일환으로 진행되고 있으며, 이 문제와 관련한 중국의 WTO 제소 및 조사 중단 요청은 미국이 여전히 세력경쟁에서 우위를 점하고 있다는 것과 향후에도 미·중 간 세력전이 차
원의 체제경쟁이 상당 기간 이어질 것임을 의미한다.

영어초록

This article aims to analyze the dispute between the U.S. and China over the recognition of China's market economy status from the perspective of power transition theory. China has been pushing for its industrialization and economic development by introducing some of market factors with reform and opening policy since 1978, and has actively pursued its entry into the WTO following the recovery of its status in GATT. However, the WTO, which was established on the premise of the market economy, provided the cause of the disputes over China’s market economy status expected around 2016, when the fifteen year grace period set at the time of China's joining the WTO in 2001 was over due to institutional insufficiency in terms of non-market economy treatment.
China has insisted on the ending of surrogate country methodology and automatic acquisition of market economy status from December 2016 and
urged the EU and the United States to use China's domestic prices to calculate
anti-dumping tariffs, but the United States insisted that China's transition is insufficient, China is going on contrary, and therefore China is still a non-market economy.
The dispute between the U.S. and China over the market economy status goes beyond the mere interpretation of provisions or economic gains and losses; it is proceeding as part of the competition between the existing and emerging powers over political and economic identity, development model, and global governance. China’s request for the suspension of the WTO panel investigation regarding this issue can be seen as an example of the interpretation that the U.S. still occupies the superior position in the power competition and that the dispute and competition from the perspective of power transition surrounding the different political and economic system between the U.S. and China will continue for a considerable period of time in the future.
