초록

조세에 대한 행정적 불복절차로는 과세전적부심사, 이의신청, 심사청구, 심판청구 및 감사원의 심사청구 등이 있고, 사법적 불복절차로는 행정소송이 있다. 행정소송의 제기에 있어 행정심판을 필요적으로 거칠 것인지에 대하여 행정소송법은 임의적 전치주의를 원칙으로 하면서 예외적으로 개별 법률에서 필요적 전치주의를 취하면 그에 따른다고 되어 있다.
조세에 대하여 행정소송을 제기하는 경우에 국세에 있어서는 국세기본법에서 특별행정심판인 심사청구, 심판청구 또는 감사원의 심사청구 중 어느 하나를 거칠 것을 요하는 필요적 전치주의를 취하고 있다. 지방세에 있어서는 구 지방세법에서 이의신청과 심사를 거칠 것을 요하였으나 헌법재판소가 2001. 6. 28 심사기관의 독립성ㆍ공정성이 없고 심리절차에 있어 사법절차가 준용되지 않음을 이유로 행정심판전치주의 규정에 대하여 위헌결정을 하였다. 그로인하여 구 지방세법에서의 필요적 전치제도가 폐지되었다.
그 뒤 지방세기본법이 2010. 3. 31 제정되고 2011. 1. 1 시행되었는데, 이 법에 의하면 심사청구에 있어서는 국세기본법 이상으로 심사기관의 공정성을 보장하고 심리에 있어 사법절차를 취하고 있으며, 심판청구와 감사원의 심사청구에 있어서는 국세와 같이 독립성ㆍ공정성이 있는 조세심판원, 감사원에서 담당하고 있다. 또한 심사청구 등에 관하여 행정심판전치주의를 포함한 국세기본법의 심사와 심판에 관한 사항을 준용하는 규정을 두고 있다.
따라서 지방세기본법에서는 구 지방세법과는 달리 지방세에 대한 행정소송에서 국세와 같이 심사청구, 심판청구 또는 감사원의 심사청구 중 어느 하나를 거쳐야 하는 행정심판전치주의를 취하고 있는 것으로 해석할 수 있다.

There is national taxes and local taxes, Do taxes and Si/Gun taxes in local taxes. If you receive an unlawful or unreasonable disposition in tax, may file Administrative Appeals and Administrative Litigation. There is Pre-Taxation Review, Objections, Examination and Adjudgment in Administrative Appeals on taxes.
A person who receives notification falling written notice of results in tax investigation etc, may request a judgment on whether the content of notification is legal, that called Pre-Taxation Review.
And the person who intends to raise an objection shall fill such an objection to Do governor in case of Do taxes and to the head of Si/Gun in case of Si/Gun taxes. And he shall file to make a request for examination to Do governor or a request for adjudgment to the Tax Tribunal in case of Si/Gun taxes. Even if an administrative appeal may be instituted against a disposition in question pursuant to the provisions of Acts and subordinate statutes, a administrative litigation may be instituted without doing so, by Administrative Litigation Act. There are provisions that a administrative litigation may not be instituted without going through an administrative adjudication on a disposition in question in other Acts, the same shall not be applied.
But any administrative litigation against an illegal disposition in National taxes, shall not be filed without making a the request for examination or a the request for adjudgment and the decision thereof by Framework Act on National Taxes.
That there are not provisions that a administrative litigation may not be instituted without going through an administrative adjudication on a disposition in question in Framework Act on Local Taxes. But, expect for matters prescribed by Local Act, Examination and Adjudgment of the Framework Act on National Taxes shall apply mutatis mutandis to administrative appeals on local taxes, by Article 127, Framework Act on Local Taxes that is legislated Mar, 31, 2010. enter into forced Jan, 1, 2011.
Therefore, any administrative litigation against an illegal disposition on Local taxes, may not be instituted without going through an administrative adjudication on the administrative appeal.
