미국 탄소국경세 관련 3개 법안의 대상품목 HS 코드 정의 비교 연구 (Study on HS code definitions for targeted items in three U.S. carbon adjustment related bills)

초록

본 연구는 최근 주요 쟁점으로 부각되고 있는 탄소국경세와 관련하여 2026 년 시행을 앞둔 EU 탄소국경조정제도(CBAM)와 미국에서 발의된 3개 법안, 즉, 청정경쟁법(CCA), 외국오염 수수료법(FPFA), 탄소집약도 조사법(PIA)에 대해서각 대상품목 HS 코드를 6단위로 도출하여 특징을 비교하고 수출통계를 분석하였다. 이 중 EU CBAM, 청정경쟁법과 외국오염 수수료법은 직접적으로 탄소국경세를 징수하기 위한 부분이 포함된 법안으로서 국내 산업에 대한 파급효과 분석과 대응방안 수립이 시급하다. 그리고, 그 파급효과 분석과 대응방안 수립을 위해서는 부과 기준에 대한 파악뿐만 아니라 대상품목에 대한 HS 코드 정의를 확정하고 최근 연간 수출통계를 집계하여 기초 자료로 활용할 필요가 있다.
미국 외국오염 수수료법 대상품목의 HS 코드 6단위 범위와 수출중량이 미국 청정경쟁법이나 EU CBAM 보다 광범위한 것으로 확인되며, 향후 법안 통과에 대한 경과 확인이 필요하다. 또한, 향후 다른 주요국의 탄소국경세 논의를 정리하고 국내 찬반 논의를 전개하고 국내 산업에 대한 영향 분석, 산업계와 적정한정보 공유 등 대응 노력이 필요할 것으로 본다.

영어초록

In relation to the carbon border tax which has recently emerged as an important issue, this study examines the EU CBAM and three bills proposed in the United States, which are scheduled to be implemented in 2026: that is, the Clean Competition Act (CCA), the Foreign Pollution Fee Act (FPFA), and the Prove It Act(PIA). The HS codes of each target items of the four mechanisms are derived into 6 units, and this study compares and analyzes the characteristics thereof, and further, compiles and analyzes the export statistics according to the definition of each target HS code. Among these, the EU CBAM, Clean Competition Act, and Foreign Pollution Fee Act are bills proposed to directly collect carbon border taxes, so it is urgent to analyze the ripple effects on domestic industries and establish response plans. In addition to understanding the imposition standards, it is necessary to finalize the HS code definition for the target product by compiling the latest annual export amount and export weight statistics to the EU/US according to each HS code definition and using it as basic data.
As the scope of HS 6 units and the export weight of the goods subject to the US Foreign Pollution Fee Act are broader and larger than the US Clean Competition Act or the EU CBAM, it is necessary to closely analyze the impact of each bill on Korea's exports to the US and pay close attention to which bill will be passed in the US in the future. And further, Korea will need to summarize the discussions on carbon border taxes in other major countries, actively develop domestic debates on the pros and cons therefor, analyze the impact on domestic industries, and share appropriate information with domestic industries.
