골프회원권 취득세 과세의 문제점과 개선방안 (A Study on the Problems and Improvements of the Local Taxes for the Golf Course Memberships)

초록

본 연구는 골프회원권에 대한 지방세 과세체계의 문제점을 검토하고 합리적인 개선방안을제시하고자 한다. 구체적으로 본 연구에서는 골프회원권과 관련된 취득세 과세체계와 골프회원권 기한연장으로 인한 취득세 재부과에 대한 문제점를 법리적․실무적 관점에서 살펴보고, 이에 대한 근본적인 개선방안을 도출하고자 하였다.
골프회원권과 관련된 현행 지방세 과세체계를 검토한 결과, 골프회원권은 부동산 용익물권인 전세권과 같이 시설에 대한 이용권 취득에 대한 과세로 소유권을 취득하는 행위에 대한 조세인 취득세 과세대상으로 설정되기에는 본질적인 문제가 있는 것으로 판단된다. 그리고 최근 시대상황의 변화에 따라 골프업계의 경영난이 골프회원권의 존속기간 단축을 초래하고 있다. 골프회원권의 성격이 당초 고가의 투자자산에서 이용권 중심의 회원권으로 그성격이 변모하고 있기 때문에 골프회원권의 연장에 대한 취득세 재부과의 법리적 정당성에문제가 있는 것으로 판단된다.
현행 골프회원권의 지방세 과세체계의 문제점을 해결하기 위하여 다음과 같은 세 가지 개선방안을 제시하였다. 첫째, 골프회원권의 취득을 이용권의 등록으로 보아 취득세가 아닌등록면허세를 부과하는 방안이다. 둘째, 골프회원권의 기간이 단축됨에 따라 2～3년마다 취득세를 납부해야 하는 현행 취득세 과세방법의 문제를 해결하기 위해서 회원권에 대한 취득세 과세표준을 예탁금에 대한 간주이자를 기준하여 산출하는 방안이다. 셋째, 골프회원권이 사실상 레저를 위한 시설이므로 이용적인 측면에서 레저세로 전환하는 방안이다. 이와같은 방안들은 최근 골프회원권이 재산권적 성격보다 이용권 성격이 강화되고 있는 시대의흐름을 반영한 것으로 골프회원권 과세체계 개선에 대한 의미 있는 시사점을 줄 것으로 기대한다.

This study examines the problems of the local taxation system for golf membership and suggests a rational improvement plan. Specifically, this study examined the problem of the acquisition taxation system related to the golf membership and the problem of the reacquisition tax due to the extension of the golf membership period from the viewpoint of the legal and practical aspects, and found a fundamental improvement plan.
As a result of examining the current local taxation system related to golf membership, in this study, the golf membership is set as a tax acquisition tax for the act of acquiring ownership by acquiring the right to use the facility, It seems that there is an inherent problem. In addition, according to recent changes in the situation of the times, the golf industry. As the nature of golf membership is changed from high－priced investment property to membership right centered on the right of use, it is judged that there is a problem with the legal justification of reissuing acquisition tax on golf membership extension.
In order to solve the problem of the local taxation system of the present golf membership, the following three improvement measures were suggested in this study. First, the acquisition of golf membership is regarded as registration of the use right, and the registration license tax is levied instead of acquisition tax. Second, in order to solve the problem of the current acquisition taxation method which requires payment of acquisition tax every two or three years as the duration of golf membership is shortened, the acquisition tax standard for memberships is converted into a method of calculating the interest interest for deposits. Third, the membership of the golf course is transformed into a leisure dimension considering the facility utilization aspect for leisure.
The suggestions suggested in this study reflect the current trend of the golf club membership right, which is more intense than the property right, and it is expected to give meaningful implications for golf membership tax system improvement.
