내사와 수사의 구별에 관한 고찰 - 실질설에 따른 수사기관의 최초의 수사행위의 외부적 징표를 중심으로 - (Study of the Distinction between the Internal Investigation and the Investigation - Focusing on the External Sign of Early Investigation Activities of the Investigative Agency based on the Substance T)

초록

내사는 ‘수사기관이 피내사자의 범죄 혐의 유․무를 확인하기 위하여 통상의 수사를 개시하기 이전에 행하는 은밀한 조사활동’을 말한다. 내사와 수사를 구별하는 학설 중에서 피내사자의 인권보호를 기할 수 있고 형사절차법정주의에 부합한다는 점에서 형식설보다는 실질설이 타당하다. 이를 구별할 필요성은 법적통제의 유․무, 조사방법의 차이, 조사대상자들에 대한 인권보호 등의 이유로 구별되어야 한다. 수사기관의 최초의 수사행위로 볼 수 있는 구체적인 징표들로는 피의자 신분으로 출석요구하거나 피의자 신문을 개시한 때, 피내사자가 자술서를 작성하기 시작한 때, 소․고발인에게 출석을 요구한 때, 고소․고발인을 상대로 조사를 개시한 때, 고소․고발을 접수하고 공․사무소에 대한 사실조회를 요청한 때를 들 수 있다. 그리고 사법경찰관 또는 검사가 체포영장을 신청하거나 청구한 때, 수사기관이 현행범을 체포하거나 긴급체포한 때, 준현행범을 상대로 신문을 개시한 때, 현행범을 인수받고 범죄혐의를 확인하고 입건절차를 밟은 때, 일반적인 압수․수색영장을 신청하거나청구한 때, 긴급 압수․수색을 실시한 때, 변사체 검시(또는 부검)한 후, 범죄혐의를 포착하고 최초의 수사행위를 한 때, 피내사자를 지명수배를 한 때 등으로 살펴볼 수 있다.

영어초록

The internal investigation means ‘the secret investigating activity of investigative agency, which is performed before the beginning of the ordinary investigation in order to identify the crime suspicion of a suspect.’ Among the theories for distinguishing between the internal investigation and the investigation, the form theory is more appropriate than the substance theory since it allows to protect the human rights of the suspect and corresponds with the principle of crime procedure. Not only does the need for the distinction depend on whether the legal control exists or not, but it also arises from the reasons including the difference between investigation methods, and the protection of human rights of suspects. The concrete signs in the early investigation activities of the investigative agency can be found in the activities consisting of requesting for attendance as a suspect or beginning the examination of a suspect, starting to make a suspect write an affidavit, requesting for attendance of an accuser, beginning to investigate an accuser, and filing the accusation and requesting for the fact-finding inquiry of the public/government office. In addition, they can be also examined in the activities related with the request or claim for an arrest warrant by the judicial police officer or the prosecutor, the arrest(or arrest without warrant) of the red-handed, the beginning of examining the quasi-flagrant offense, the identification of crime suspicion and progress of criminal charge procedure after taking over the red-handed, the request or claim for a general seizure and search warrant, the enforcement of search and seizure without warrant, the autopsy(or postmortem) of body, the implementation of early investigation activities after detecting the crime suspicion, and the arrangements of a suspect for the search for an identified criminal.
