영국 송･변전설비의 공용수용과 손실보상- 지중선을 중심으로 - (Eminent Domain and compensation of Transmission and substation equipment in the UK - Focused on the Underground Transmission Line -)

초록

영국에서는 도시의 공간부족과 안전성의 문제 및 가스회사를 보호하기 위해 전기 송･배전선의 지하매설을 의무화하기 시작하였다. 그리고 1989년 「전기법」에 따라 송･변전설비 설치자는 전기선을 개발하거나 송전설비와 관련하여 다른 업무를 수행할 때 문화유산을 보존하기 위한 법적 의무를 부여하였다. 이런 결과 영국 런던의 전기 배전선의 지중화율은 100%이다.
지중선 설치절차는 「계획법」에 따라 지중선 설치계획서를 작성하여 계획조사단에 제출하고, 6개월간 다양한 이해당사자들이 참여하여 검토를 거친 후 에너지기후변화 국장에게 권고안을 제출하면, 국무장관의 승인을 받은 후 지중선을 설치할 수 있다.
송･변전설비를 위한 토지의 취득은 대부분 협의로 공공용지를 취득하고, 협의가 성립되지 아니한 경우에 「토지취득법」에 의해 관계 장관으로부터 강제취득명령의 확정을 받아 집행하는 구조이다. 지중선과 관련된 토지보상은 「2008년 계획법」에 따라 토지에 이해가 있는 모든 자를 확인하고 협의할 것을 요구한다.
토지취득(영구 또는 임시)의 보상액 산정기준은 시장가치를 기초로 하여 개별적으로 합의하는 것이 원칙이다. 그러나 합의에 이르지 못하거나, 보상에 대한 법적 분쟁이 발생하면 토지심판소(Lands Tribunal)에 회부하도록 규정하고 있다. 그리고 영국은 지속적인 사용에 대한 보상제도와 지역권 계약체결의 신속화를 위해 인센티브 지급제도가 있다.
이와 같이 지중선 설치의 점유율이 높은 영국의 토지수용, 토지사용, 토지보상 등 지중선과 관련된 법령과 정책의 사례를 살펴봄으로써 앞으로 한국에서 증가할 지중선 설치에 시사점을 줄 것이다.

영어초록

In Britain, it has become mandatory to lay electricity transmission and distribution lines under the ground with the lack of space in the city, safety issues, and the protection of gas companies. In accordance with the Electricity Act 1989, the installers of the transmission and substation facilities have a legal obligation to preserve cultural heritage when developing electric power lines or performing other tasks related to transmission facilities. Consequently, the underground burial rate of electricity transmission lines in London, England, is 100%.
The installation procedure of the underground transmission line gets started by submitting the underground transmission line installation plan to the planning team in accordance with the "Planning Act", and submitting the recommendation to the Director of the Energy Climate Change Bureau after six months of review by various stakeholders. After the approval of the Secretary of State, an underground transmission line can be installed.
Acquisition of land for transmission and substation facilities is mostly structured to acquire public land through consultation, but to execute the confirmed order of enforced acquisition from a relevant minister depending on the "Land Acquisition Act" if no agreement has been reached. Land compensation related to the underground requires that all the people concerned with the land are identified and consulted in accordance with the Planning Act 2008.
In principle, the criteria for calculating the amount of compensation for land acquisition (permanent or temporary) should be built on market value and then the settlement should be done on an individual basis. However, if a settlement can not be reached, or there is a legal dispute about the compensation, it is required to be referred to the Land Tribunal. In addition, the UK has an incentive payment system to accelerate the contract of easement and a reimbursement system for continuous use.
In this way, by examining the examples of laws and policies related to the underground transmission line such as land acceptance, land use, land compensation, etc. in the UK, which has a high share of the underground transmission line installation, this study will give implications for the increase of the underground transmission lines installation in the future in Korea.
