그림자 선단 유조선의 위협과 국제법적 대응 (The Shadow Fleet Tankers : Threats and International Legal Responses)

초록

2022년 러시아의 우크라이나 침공에 맞서 G7과 EU 등 서방 세계는 경제 제재의 하나로 러시아 유가 상한제를 시행하였다. 이에 따라 유가 상한제를 준수하지 않고 러시아산 원유를 수송하는 유조선은 입항 금지, 해역 접근 제한 및 선박 간 환적 금지 등 강력한 해상 차단에 직면하게 되었다. 그러나 러시아는 그림자 선단 유조선을 조직하여 이에 대응하였다. 사실 북한, 이란 및 베네수엘라 등의 몇몇 국가 역시 제재 회피를 위해 암흑 선박을 운용해 왔다. 그림자 선단은 암흑 선박에서 진화한 것이나 규모 면에서 이전과 차원이 다르다. 그림자 선단은 한 때 세계 유조선의 약 20%를 차지하기도 하였다.
국제해사기구(IMO)는 그림자 선단을 제재, 안전 또는 환경 규제, 보험 비용 등을 회피하려 하거나 불법 활동 목적으로 불법 운항을 하는 선박이라고 규정하였다. 그림자 선단은 노후하고 안전 설비가 미비한 기준미달 선박으로 보험이 없거나 부실하다는 특징을 가지고 있다. 또한 이들은 AIS 조작 및 스푸핑, 잦은 기국 변경 및 선박 신원 조작, 선박 간 환적 등 기만적 운송 관행을 보여주고 있다. 이러한 특성으로 인해 그림자 선단은 해양 환경 및 안전에 심각한 위협이 되고 있다. IMO는 2023년 12월 6일 IMO Resolution A.1192(33) 결의안에서 그림자 선단의 확산으로 인해 유류 유출 위험이 증가하고 있다고 경고하고 당사국의 대비를 촉구하였다.
최근 발트해에서는 해저 케이블과 가스관 훼손 사건이 자주 발생하고 있는데 그 원인으로 그림자 선단이 지목받고 있다. 러시아의 위협에 가장 민감한 입장의 EU 의회는 2024년 11월 그림자 선단 제재에 관한 포괄적 결의안을 채택하였다. 이 결의안은 선박 지정 등 구체적 제재 방안과 함께 위성이나 드론을 활용한 모니터링 강화를 권고하였다. 그림자 선단의 규모 변화 등을 추적해 보면 입항 금지, 선박 간 환적 금지 등은 러시아의 우회로 확보로 인해 효과가 거의 없었던 반면 선박 지정 등은 다소 효과가 있었다고 볼 수 있다. 종합적으로 볼 때 그림자 선단에 대한 제재는 성공했다고 하기는 어렵다.
결국 유엔해양법협약에 의한 대응이 중요하다. 해양법협약에 의하면 해양 안전 보장에 관한 1차 책임은 기국에 있다. 해양법협약 235조는 국가가 강제 보험이나 보상 기금과 같은 적절한 보상의 지급을 위하여 협력해야 할 의무를 강조하고 있다. 그림자 선단이 초래하는 해양 환경 및 안전 위협 문제에 대해 기국은 적절한 보상을 위해 협력해야 하는 의무를 준수해야 한다. 그런데 기국이 제재를 회피하려는 당사자이거나 편의치적국인 경우 이러한 의무를 충실하게 이행하려는 의지가 부족하다. 따라서 연안국의 관할권을 강화하는 것이 이상적이나 이는 해양법협약을 개정하지 않는 한 어려운 일이다. 그러나 배타적 경제수역에서의 환적가능구역 설정, 선박 간 환적 제한, 선박 간 환적 작업의 식별 및 감시 등 연안국의 권한 강화를 통해 그림자 선단의 확산을 방지할 수 있을 것이다.

영어초록

In response to Russia's invasion of Ukraine in 2022, the Western world, including the G7 and EU, implemented an oil price cap on Russian oil as part of economic sanctions. Consequently, oil tankers transporting Russian oil without complying with the price cap faced strong maritime blockades, including port entry bans, restricted access to waters, and prohibitions on ship-to-ship transfers. However, Russia responded by organizing a shadow fleet of tankers. In fact, several countries like North Korea, Iran, and Venezuela have also operated dark ships to evade sanctions. The shadow fleet evolved from dark ships but differs significantly in scale. At one point, shadow fleets constituted approximately 20% of the world's oil tankers.
The International Maritime Organization (IMO) has defined shadow fleets as vessels operating illegally to evade sanctions, safety or environmental regulations, insurance costs, or for illegal activities. Shadow fleets are characterized as aging, substandard vessels with inadequate safety equipment and non-existent or inadequate insurance. They also employ deceptive transportation practices such as AIS manipulation and spoofing, frequent flag changes, vessel identity manipulation, and ship-to-ship transfers. Due to these characteristics, shadow fleets pose a serious threat to maritime environment and safety. On December 6, 2023, in IMO Resolution A.1192(33), the IMO warned that the proliferation of shadow fleets is increasing the risk of oil spills and urged member states to prepare accordingly.
Recently, incidents of damage to undersea cables and gas pipelines in the Baltic Sea have occurred frequently, with shadow fleets being identified as the cause. The EU Parliament, in its most vulnerable position to Russian threats, adopted a comprehensive resolution on shadow fleet sanctions in November 2024. This resolution recommended specific sanction measures, including vessel designation, along with enhanced monitoring using satellites or drones.
By tracking changes in the scale of shadow fleets, it appears that port entry bans and prohibitions on ship-to-ship transfers had little effect due to Russia's securing of alternative routes, while vessel designation had somewhat more effect. Overall, sanctions against shadow fleets can hardly be considered successful.
Ultimately, a response based on the United Nations Convention on the Law of the Sea (UNCLOS) is important. According to UNCLOS, the primary responsibility for ensuring maritime safety lies with the flag state. Article 235 of UNCLOS emphasizes the obligation of states to cooperate for the payment of adequate compensation, such as compulsory insurance or compensation funds. Flag states must comply with the obligation to cooperate for appropriate compensation regarding maritime environmental and safety threats posed by shadow fleets. However, when the flag state is either the party trying to evade sanctions or a flag of convenience country, there is a lack of willingness to faithfully fulfill these obligations. Therefore, while strengthening coastal state jurisdiction would be ideal, this is difficult without amending UNCLOS. Nevertheless, the spread of shadow fleets can be prevented through strengthening coastal state authority, such as establishing permitted zones in exclusive economic zones, restricting ship-to-ship transfers, and identifying and monitoring ship-to-ship transfer operations.
