분재기를 통해 본 외손봉사 별급과 봉사 승계 - 예천 동래정씨 석문공종택을 중심으로 - (Oeson-bongsa Special inheriting and bongsa Succession through the records of property inheritance - Focusing on the Seokmun Branch of the Dongnae Jeong Clan in Yecheon -)

초록

조선 전기에는 종법질서가 자리 잡지 않아 자녀가 없을 경우 양자를 들여 가계를 계승하기도 하였지만, 자신들의 사후 봉양을 외손들에게 재산을 상속하고 봉사를 지내게 하는 외손봉사가 이루어지기도 하였다.
본 논문은 조선 전기 외손봉사로 인한 재산상속과 승계에 대하여 예천 동래정씨 석문공파 분재기를 통해 살펴본 것이다. 동래정씨 석문공파에 전래된 고문서는 조선 전기 외손봉사로 인한 재산 상속과 승계가 어떻게진행되었는지 살펴볼 수 있는 분재기가 전하고 있다.
권제세와 그의 처 안동권씨는 혼인 후 딸만 다섯을 낳자 입후를 들이는 대신 첫째 딸의 남편인 정원건을봉사를 담당하는 의미로 후사로 삼고 자신들의 봉사를 담당하게 하였으며, 대수가 다하더라도 지속해서 봉사를 지내줄 것을 당부하였다. 이러한 모습을 통해 사후 봉양을 가계 계승과 비슷하게 인식했던 모습을 살펴볼 수 있었다. 정원건은 처모로부터 별급받은 재산에 대해 관으로부터 사급입안과 배탈사급입안까지 받음으로써 봉사로 별급받은 재산의 소유를 명확히 하였고, 훗날 예상치 못한 일에 대비하였다.
이후 17세기 중반에는 이들에 대한 외손봉사가 끊기지 않고 외증조모의 유언을 그대로 이어나갔다. 정영방은 장자에게는 증조부모의 제사를 담당하게 하였고, 둘째 아들에게 외증조부모의 제사를 받들도록 하였다. 뿐만 아니라 외가의 신주를 모시도록 별도로 재사와 주사를 짓게 하였고, 약식으로나마 전을 올리며 자손들끼리 우의를 다짐으로써 외증조부모의 유언에 보답하고자 했다.

영어초록

In the early Joseon period, the system of family law had not yet been established, leading to the adoption of sons(養子) for the continuation of family lines when there were no male heirs. However, oeson-bongsa(外孫奉祀: ancestral rite system succeeded by daughter and herdescendant) were also performed to ensure the inheritance of properties and the performance of rites by maternal grandsons for their support after the parents’ death. This paper examines the inheritance and succession of properties resulting from external grandson rituals in the early Joseon period through the Bunjaegi(分財記). of the Seokmun branch of the Dongnae Jeong clan(東萊鄭氏) in Yecheon(醴泉).
The historical documents passed down in the Seokmun branch of the Dongnae Jeong clan include records that provide insight into how property inheritance and succession occurred due to external grandson rituals during the early Joseon period. Gwon Je-se(權濟世) and his wife, Andong Gwon clan (安東權氏), after having five daughters, adopted their first daughter’s husband, Jeong Won-geon(鄭元 健), to perform their rituals, emphasizing the importance of continuing the ancestral rites even after their lineage ended. This reflects their recognition of posthumous support as similar to the continuation of the family line. Jeong Won-geon clearly established ownership of the properties received for the rituals by obtaining approval from the government for the distribution of these assets, preparing to safeguard against unforeseen circumstances in the future.
By the mid-17th century, the practice of external grandson rituals persisted, adhering to the wishes of the maternal great-grandmother. Jeong Yeong-bang(鄭英邦) assigned the responsibility of performing the rituals to his eldest son for the great-grandparents and designated the second son to honor the great-grandparents on the maternal side. Additionally, he built separate ritual houses(齋舍) and kitchens(廚舍) to house the ancestral tablets of the maternal family and made offerings, even if in a simplified manner, to reaffirm the bonds among descendants and honor the wishes of their great-grandparents.
