샴쌍생아 분리수술의 정당성에 관한 소론 (A Brief Review on Justification of the Operation to Separate of Siamese Twins)

초록

사회적으로 샴쌍생아는 신체의 일부가 서로 유착하여 연결된 이중체로 이해한다. 샴쌍생아의 기형은 유착된 중복부위에 따라 출생 후에 쌍생아 각각의 생존과 생활 자체에 심각한 문제를 초래한다. 이러한 현실적 어려움은 태아상태를 정기적으로 확인할 수 있는 보건관리시스템에서 샴쌍생아가 확인된 경우에 임산부의 선택과 의료행위로 낙태를 하거나 조기출산을 시도하여 생존출생 후 사망에 이르게 하는 원인이 될 수도 있다.
심장박동이 생존의 기준인 이유는 의식의 활성화를 기대하는 것이고 뇌사의 기준을 심각하게 논의하는 것도 의식의 소멸을 확인하려는 노력이라고 본다면 사람이라는 개체의 단위는 의식의 가능성이라고 본다. 그러므로 생존하는 샴쌍생아의 경우에도 의식의 존재 또는 존재가능성을 가지는 사람으로서 각각의 주체성을 인정하는 것이 당연하다. 샴쌍생아의 상호 또는 대외적 법률관계는 원칙적으로 쌍생아 각각의 주체성을 인정하는 것을 원칙으로 하고 신체의 유착에 의하여 분리가 불가능한 법률관계에 있어서는 2인 동체의 법리를 배제해야 할 이유도 없다.
그럼에도 불구하고 샴쌍생아가 생존하여 출생한 후에 분리수술과정에서 샴쌍생아 일방의 사망을 포함한 희생을 감수하는 경우도 빈번하게 나타나고 있다. 그러나 샴쌍생아 상태에서는 장기간의 생존이 어렵다는 의학적 판단에 의존하여 보호자 또는 의사의 결정에 따라 샴쌍생아 일방의 생명 또는 신체적 위험을 수반하는 분리수술을 하는 것은 그 정당성에 의문을 남긴다. 샴쌍생아의 신체훼손이나 생명에 관한 판단은 분리기술과 생존가능성에 관한 의학적 비교형량으로 해결되는 것이 아니라 생존하고 있는 샴쌍생아 각각의 주체성과 일방의 피해를 고려해야하기 때문이다.
샴쌍생아 각각의 생명과 신체의 보호는 쌍생아 상호의 공정성이나 합리적 형평으로 판단하는 것이 아니라 전적으로 각각의 샴쌍생아를 인간으로서 존엄성을 존중하는 것이어야 한다. 다른 사람을 구하기 위해 한 사람을 죽일 것인가 아니면 두 사람 모두 죽게 내버려 둘 것인가라는 고민이 아니라, 사람은 다른 사람을 구하는 도구가 아니며 자신을 도구로 삼아 다른 사람을 구할 것인가 여부는 구하는 사람의 헌신이라는 윤리적 깊이를 고민할 필요가 있다. 그리고 이러한 헌신은 친권자나 법원이 결정할 수 없는 헌신이다. 친권자나 법원이 샴쌍생아의 힘든 모습을 지켜보는 마음은 무책임이 아니라 사람의 존엄성을 분명히 하는 문명사회가 지켜야할 정신이기도 하다.
생존하는 사람의 존엄성은 관념적으로 존재하며 현재의 실체가 완전할 것을 요구하지 않는다. 사람이 더 이상 생존할 수 없다는 판단은 얼마나 많은 시간이 남았는가를 추측하는 문제이며 예상하는 생존기간이 짧다고 해서 생명권의 무게가 가볍다고 할 수 없다. 질병, 노화, 죽음을 극복하려는 노력은 인간의 존엄성을 존중하는 규범의식을 전제로 하여야만 한다.

Socially, Siamese twins are understood as a connected dual body in which parts of the body bond with each other. The deformities of Siamese twins result in serious problems in their respective survival and life itself after birth, depending on the attached overlap. The real problem is that if Siamese twins are identified in the health care system, they will have to have an abortion. There is also a strong need for separation surgery after birth.
If the reason why heartbeat is the criterion for survival is to expect the activation of consciousness, and if discussing the criteria of brain death is an effort to confirm the disappearance of consciousness, the unit of the human body is considered to be the possibility of consciousness. Therefore, it is natural for Siamese twins to recognize their identity as one person with the presence or possibility of consciousness. In principle, the mutual or external legal relationship of Siamese twins should be recognized for their respective identity, and there is no reason to exclude the legal principle of the two-part body when it comes to legal relations that cannot be separated due to bodys.
After a Siamese twins survive and are born, there are many cases where they make sacrifices, including the death of a Siamese twins, during operations to separate.
It should be reconsidered for person with parental rights or doctor to decide on separation surgery involving life or physical risks of Siamese twins by resorting to medical judgment that it is difficult to survive for a long period of time after birth. Judgment on body damage or life of Siamese twins should be based on the legal basis of separate surgery at the expense of one-sided sacrifice and identity of each surviving Siamese twins, not on the medical discussion of separation techniques and viability.
The protection of each life and body of a Siamese twins should not be judged by the fairness or rational equity of each other, but by all means respecting the dignity of each Siamese twins as human beings.
What we have to worry about is not whether to kill one person to save another or let both die. Because one is not tools to save others. One must understand that using oneself as a tool to save others is an ethical depth of sacrifice for others. And these sacrifices are sacrifices that person with parental rights or court cannot decide. It seems irresponsible for person with parental rights or court to have to watch the twins live without surgery or any medical practice, but it is also the spirit of a civilized society that clarifies the dignity of a person.
The dignity of a survivor is ideologically present and does not require the present entity to be complete. The judgment that a person can no longer survive is a matter of guessing how much time is left, and the expected short duration of survival does not make the life-right light.
One must be on guard so that the passion to overcome disease, aging and death does not result in the tooling of human beings.
