행정소송상 조정권고에 대한 인식 개선과 발전 방향 (Awareness Improvement and Development Direction of Judicial Recommendation for Conciliation in Administrative Litigation)

초록

행정소송에서는 민사소송과는 달리 조정･화해의 법률상 근거가 없으나, 행정재판 실무에서는 ‘사실상의 조정’으로서 「재판부의 조정권고 → 피고의 취소･변경처분 → 원고의 소취하」로 이루어지는 조정권고 제도가 시행되고 있다. 하지만 행정소송에서 조정권고 제도의 활용도는 상대적으로 높지 않은 편인데, 그 원인은 비단 조정권고 제도에 관한 법률상 명문의 근거 규정이 없다는 규범적 상황뿐만 아니라, 행정소송사건을 둘러싼 재판부, 원고, 피고 행정청, 행정소송 지휘를 담당하는 법무부 등이 조정권고 제도에 대하여 가지는 인식의 차이에서 비롯된 것으로 생각한다. 행정사건에서의 조정에 관한 행정소송법의 개정이나 단행법의 제정은 현재 어려운 상황에 놓여 있는바, 실무상 행해지고 있는 행정소송상 조정권고 제도의 실무를 파악하고 조정권고의 활용 방안에 관해 연구하는 것이 현실적이다. 본 논문에서는 행정소송상 조정권고 제도의 운영 현황을 살펴보고(Ⅱ.), 조정권고 제도에 대한 인식이 변화될 필요성을 각 행정소송사건 관련 주체별로 검토하며(Ⅲ.), 조정권고 제도가 바람직한 방향으로 발전하기 위한 방안(Ⅳ.)을 차례로 분석･검토한다.

영어초록

In administrative litigation, unlike civil litigation, there are no statutory grounds for judicial conciliation or compromise. However, in the practice of administrative trials, when the court recommends conciliation, the administrative agency (on the dependant’s side) revokes or alters the administrative disposition and the plaintiff withdraws the lawsuit. This recommending a conciliation by a court can be regarded as de facto judicial conciliation or compromise.
The utilization of judicial recommendation for conciliation in administrative litigation is not high. The following can be assumed as the cause. Not only are there no statutory grounds for judicial recommendation for conciliation, but there are also awareness gaps of that recommendation system for administrative litigation among judges, plaintiffs, administrative agencies responsible for administrative litigation, and prosecutors in charge of directing administrative litigation.
For those who affirm the judicial conciliation in administrative litigation, stipulating it through legislation will be a fundamental solution. However, in a situation where it is difficult to revise the Administrative Litigation Act or enact a separate law on conciliation in administrative cases, it would be realistic to seek ways to utilize the judicial recommendation for conciliation, which is being practiced under the current law.
In this paper, considering this circumstance, I reviewed the awareness improvement and development direction of the judicial recommendation for conciliation. First, the utilization status of the judicial recommendation for conciliation in administrative litigation was examined. Next, by analyzing the practical benefits and positive aspects of dispute resolution through the judicial recommendation for conciliation, the necessity of raising awareness of it was reviewed. In addition, comparative legal implications were sought by looking at examples of foreign countries related to conciliation in administrative litigation. Furthermore, the plans for the development of the judicial recommendation for conciliation system in a desirable direction and matters to be noted in trial practice related to it were also reviewed.
