초록

지방자치의 제도적 중요성에도 불구하고 지방자치의 구체적 형성에 대해서는 다양한 견해가 대립되지만, 적어도 지방소멸의 위기가 논의될 정도로 수도권 집중이 큰 병폐가 되고 있는 우리나라에 있어 국가의 균형발전은 당연한 규범적 과제이자, 지방분권과 불가분의 관계에 있다는 것은 부인할 수 없는 사실이다.
그러한 점에서 우리나라의 지방자치는 지방에 대한 분권의 문제를 넘어, 지방자치단체 간의 균형적 발전이라는 이중의 목표를 갖는 점에서 지방자치의 구체적 실현 및 제도화에는 현실적 난제가 많다. 동시에 지방자치제도의 구체적 형성에 있어서는 국가와 지방자치단체 간의 협력관계에 대한 제도적 설정이 중요한데, 여기에는 실체적인 것도 있지만 그 과정과 절차에 대한 것 역시 그에 못지않게 중요한바, 그 핵심적인 제도적 장치에 해당하는 것이 현재 추진되고 있는 지방시대위원회이다.
지방시대위원회는 종래 지방분권법에 따른 자치분권위원회와 국가균형발전법에 따른 국가균형발전위원회로 추진 체계가 분산된 탓에 지방분권과 균형발전의 연계 측면에서 한계가 있었다는 문제의식에 따라, 양자를 통합한 지방시대위원회를 지방분권 및 균형발전의 컨트롤타워로 한다는 기본구상에 따라 제도화되었다. 지방분권과 균형발전은 기본적으로 지방자치의 이념과 궤를 같이 하는 것으로 실질적으로는 동전의 양면에 해당하는 것으로, 서로 목적과 수단의 관계에 있다고 할 것인바, 양자의 통합을 기본이념으로 하는 지방시대위원회를 출범시키는 것은 기본적으로는 타당한 방향이라고 보인다.
다만 그럼에도 불구하고 지방시대위원회가 그 지위와 역할에 대한 충분한 사회적 합의를 거쳐 추진되는 것인지에 대해서는 근본적인 의문이 있으며, 특히 지방시대위원회는 그 본래적 기본구상과 달리 자문기구에 불과하게 되면서 지방자치법제에서 요구되는 역할과 기능을 수행하기는 어렵다고 보인다. 거기에 지방시대위원회의 구성을 포함하여 지방분권 및 균형발전의 추진주체나 체계 역시 우리나라 지방자치의 고질적인 병폐라 할 수 있는 국가주도적인 구조를 여전히 벗어나지 못하고 있다고 보이는 동시에, 종래의 자치분권위원회와 국가균형발전위원회의 분산 체제에서의 문제점에 대한 파악을 통한 양자의 화학적 결합이 아닌 단순한 물리적 결합에 불과한 점에서 종래의 문제점에 대한 개선의 해답을 찾기는 여전히 쉽지 않아 보이는 등 제도의 도입에 대한 기대에 비해 그 우려가 큰 것이 사실이다.
기왕에 어렵게 출발한 지방시대위원회가 지방자치의 오랜 숙제이자 병폐인 국가 주도의 후견적 지방자치를 뒷받침하는 허울뿐인 위원회가 되어서는 곤란한바, 향후 제도의 운용과정에서의 충분한 개선과 노력을 통해 지방시대위원회가 이상적이고 성숙한 지방자치의 실현을 위한 초석이 되기를 기대해 본다.

영어초록

Despite the institutional importance of local autonomy, various views are opposed to the specific formation of local autonomy, but it is undeniable that balanced national development is a natural normative task and inextricably linked to decentralization in Korea, where the crisis of local extinction is discussed.
There are many practical challenges in realizing and institutionalizing local autonomy in that local autonomy in Korea has a dual goal of balanced development among local governments beyond the issue of decentralization. At the same time, institutional establishment of cooperative relations between the state and local governments is important in the specific formation of the local government system, in this regard, substantive cooperation is important, but cooperation in the process and procedure is also as important as that, so it is the local time committee that is currently being promoted as a key institutional device for this.
The Local Era Committee was created in accordance with the problem consciousness that there were limitations in terms of connection between decentralization and balanced development because the promotion system was dispersed into the Autonomous Decentralization Committee and the Balanced Development Committee in the past, it was institutionalized according to the basic plan to make the Local Times Committee, which integrates the two organizations, into a control tower for decentralization and balanced development. Decentralization and balanced development are basically in line with the ideology of local autonomy and correspond to both sides of the coin, and it is said that they are in a relationship between purpose and means, so it seems basically a reasonable direction to launch the Local Era Committee based on the basic ideology of the integration of the two.
Nevertheless, there is a fundamental question as to whether the the Local Era Committee is promoted through sufficient social consensus on its status and role, and in particular, it seems difficult to perform the roles and functions required by the local government legislation as it is only an advisory body unlike its original basic plan. In addition, including the composition of the Local Era Committee, the subjects and systems of decentralization and balanced development still seem to have not escaped the state-led structure, which is a chronic disease of local autonomy in Korea. At the same time, it seems difficult to find an answer to the improvement of the existing problems in that it is not a chemical combination through identifying the problems in the decentralized system of the Autonomous Decentralization Committee and the Balanced Development Committee in past but a simple physical combination of the two organizations.
As the institutional introduction of the Local Era Committee began with difficulty, it should not be a false committee that supports state-led guardianship, which is a long-standing task and disease of local autonomy in Korea, and we hope that the Local Era Committee will become a cornerstone for realizing ideal and mature local autonomy through sufficient improvement and efforts.
