무역거래상 채권매입금융방식의 특성에 관한 연구 (A Study on the Characteristics of the financing of purchasing the trade receivables in International Trade)

초록

최근 수출채권매입에 의한 무역거래가 빈번히 발생하고 있으며 그와 동반하여 관련 무역거래사고와 범죄가 늘어나고 있다. 따라서 본 연구에서는 수출채권매입금융의 특성을 기존의 전통적 거래방식인 신용장방식의 금융과 차이점을 비교하는 형식으로여 분석하였다. 주요 내용으로는 수출채권매입금융의 장점과 양도과정, 수출채권금융의 국제관습, 양도과정상 무역현장과 관련금융기관의 실무상 유의점, 등을 법원의 판결문과 관련지어 분석하였다. 결론적으로 수출채권 매입금융은 기존의 신용장부 무역금융에 비해 갖는 리스크가 크며 관련당사자는 거래시 주의가 필요하다고 할 수 있다.

영어초록

Purpose : The payment methods used in the process of international trade transactions are in the process of changing from the traditional letter of credit method to a new type of payment methods. Payment-related global forums are being actively conducted. The financing through purchasing of the trade receivables is intended to be spreaded all in the world. Therefore the necessity of study against this kind of financing is increasing for the expansion of the external trade volume, so in this study, the characteristics and proceeding of as above financing are studied. It can be expected that the volumes of external trade are extended and also the effect of crime prevention by this.
Research design, data, methodology : This paper reviewed and analyzed the recent sentences by judgment in our country about the case of the financing the trade receivables by Open Account transaction and also be investigated the sentence of our country about the fraud transaction of L/C. Many of the foreign and domestic articles also analyzed.
Conclusions : As the financing of the purchasing the trade receivables by Open Account have not the international unified regulation and only be controled by the local commercial law and the execution of this kind of financing is very dangerous compared with L/C transaction, In the future, the countermeasure of the prevention of such crime must be made.
