국제법상 제3세대 인권과 국내적 이행 (Third Generation Human Rights under International Law and National Implementation)

초록

인권법은 발전단계에 있고, 이 과정에서 제3세대 인권은 변화하는 시대의 산물이다. 체코 법률가 Karel Vasak은 프랑스혁명의 정신인 “자유, 평등, 박애”를 모토로 하여, ‘자유’의 정신인 제1세대 인권(자유권), ‘평등’의 정신인 제2세대 인권(평등권), ‘박애’의 정신에서 비롯되는 제3세대 인권(집단권, 연대권)으로 인권을 분류하고 3세대 인권개념을 처음으로 사용하였다.
제3세대 권리는 인권이념에 뿌리를 두기보다는 식민화 경험에서 그 근원을 찾는다. 근거가 되는 사상은 연대이다. 인권은 개인 만이 향유할 수 있다고 보았는데 제3세대 인권은 ‘인민’과 ‘국가’도 이 권리를 향유할 수 있다는 것이다. 제3세대 권리는 사회공동체에서 이미 인정된 1세대 2세대 권리를 보장하고 완성시키는 권리로 보고 있다.
제3세대 권리는 다음으로 구성된다 : 정치적, 경제적, 사회적 및 문화적 자결권, 경제적 및 사회적 개발권, 인류의 일반유산개발과 사용에 참여할 권리, 평화권, 깨끗하고 건강한 환경에서 살 권리, 소통과 인도적 지원을 받을 권리, 성별, 종족, 종교적, 언어적 등의 소수자 권리.
제3세대 권리는 아직 형성 과정에 있고 가장 현실적인 방법은 국가관행을 통하여 현지 입법과 법적용 과정에서 개념의 확대와 유연성을 띤 법적 개념으로 발전시켜 나갈 수 있다.
현재 세계는 인권 공동체 내에서 ‘자유’ 우선에서 ‘평등’ 우선으로 바뀌고 있고, 우선순위가 개인보다는 집단으로 현저히 이동하고 있다. 이러한 방향 전환은 기본권을 강화하고 완성시키는 효과를 가져온다는 결과를 확인하고 있다. 생존권 중심에서 공존권 중심의 사고의 전환과 전략이 생존권을 보장하는 길임을 인식하기 시작하였다.

영어초록

Human rights law is in the development stage, and in this process third-generation human rights are the product of a changing era. Czech lawyer Karel Vasak, with the motto “Freedom, Equality and Fraternity” of the spirit of the French Revolution classified human rights are into three generation human rights : first generation (liberty rights) of ‘freedom’, second generation human rights (equal rights) from the spirit of ‘equality’, and third-generation human rights (collective rights, solidarity rights) stemming from the spirit of ‘fraternity’, and the concept of third-generation human rights is used for the first time by him.
Third generation rights are not rooted in human rights ideology, but rather in the experience of colonization. The underlying idea of the rights is solidarity. Human rights were believed to be enjoyed only by individuals, but the third generation human rights is that ‘peoples’ and ‘states’ can also enjoy this right. Third-generation rights are viewed as rights that guarantee and complete the rights of the first and second generations that have already been recognized by the social community.
Third-generation rights consist of : the right to political, economic, social and cultural self-determination; the right to economic and social development; the right to participate in the development and use of the general heritage of mankind; the right to peace; rights of minorities, such as sexual, ethnic, religious, or linguistic rights.
Third-generation rights are still in the process of being formed, and the most realistic way is to develop a legal concept that is flexible and expands the concept in the process of local legislation and legal application through state practice.
Currently, the world is shifting from a priority of ‘freedom’ to a priority of ‘equality’ within the human rights community, and the priority is shifting markedly to groups rather than individuals. It is confirmed that this change of direction has the effect of strengthening and perfecting basic rights. It began to recognize that a shift in thinking and strategy centered on the right to coexistence from the center of the right to life is the way to guarantee the right to life.
