헌법상 성평등의 현대적 이해와 실현방향 (Contemporary Meaning and Realization of Gender Equality in the Constitution)

초록

평등에 대한 젠더적 이해는 성평등을 완성하는 필수불가결한 근본조건이다.
성불평등 현실 문제의 근본적 해소와 실질적 성평등을 구현하기 위해서는 젠더적 관점이 입법과 규범해석에 반영되고 평가되어야 한다. 이 논문은 헌법의 ‘성평등’ 규범 명령을 구현한 지난 입법과 법해석의 경향을 젠더적 관점을 반영하여 검토하였으며, 이에 근거한 문제를 제기하였다. 그리고 ‘성 평등’ 규범의 이해와 실제적 구현의 관철을 위해 평등원칙과 헌법의 다른 가치 규범원리들을연결하여 법이론을 보강하고자 하였으며, 그 실현 방향을 논의하고자 하였다.
1. 헌법의 이상이 ‘모든 개인’의 인간존엄과 가치의 실현, 자유와 평등에 관한 기본권의 보장이라는 점에서 성평등 규범의 해석과 실현도 이와 동일한 이상을 지향하여야 한다. 즉, ‘모든 개인’의 성차에 따른 권력 불평등 시정의 추구가 헌법적으로 보장되어야 하며, 여기에 특정집단이 배제되지 않아야 한다.
2. 평등에 대한 규범해석은 동일성과 차이에 대한 이해, 법적평등과 실질적평등과의 간극에 대한 이해가 매우 중요하며, 이러한 간극을 해소하기 위해서는불평등 당사자 관점의 이해가 반영되어야 한다. 성중립적인 관점은 존재하지 않으며, 성불평등을 심화시키거나 실제적 성평등의 구현을 방해하는 기제가 된다.
한편 기존의 헌법규정과 관련 입법에서의 실질적 평등실현 조치들은 여성의 신체적 기능 차이에 집중하여 추진되어 왔다. 그리고 그 기저에는 남성 지배적인 국가주의적 관점, 보호주의, 가부장적 전통문화의 관습, 강력한 모성신화의 내재와 자녀출산과 양육으로 완성되는 정상가족 이데올로기가 발현되고있으며, 성평등 규범의 실현도 실제로 이러한 틀 안에서 구획되고 추진되었다는 것을 지적할 수 있다. 평등이념 속에 혼재된 이 같은 이데올로기들, 성별고정관념들은 제거되어야 하며, 오늘날 성평등의 추진이 헌법이 지향하는 근본적 가치들과 부합하는지 정당화되어야 한다. 그리고 궁극적으로 헌법 주체의자유와 평등실현에 부합하지 않는다면 그 방향성은 재정립되어야 한다.
3. 성불평등 현실의 개선을 위해서는 국가의 역할과 개입이 중요하다. 국가의 성평등실현조치는 궁극적으로 개인의 인간존엄을 실현하는 방향으로 추구되어야 하며, 법치주의·사회국가원리· 민주주의와 함께 모색되고 실천되는 것으로 지향되어야 한다. 성평등 규범의 가치가 실질적 법치주의와 사회국가원리, 민주주의 이념에도 내재되어 있기 때문에 성평등은 평등원칙과 함께 다른헌법원리들과의 조화로운 실천으로 완성되어질 수 있다. 특히 불평등의 주체가 정치적 주체로서 목소리를 낼 수 있도록 참여를 보장하는 것이 무엇보다중요하다는 점에서 민주주의와 성평등은 분리될 수 없으며, 그 연관성이 강조되어야 한다.

영어초록

Gender equality is a fundamental understanding of the conditions essential tocomplete gender equality. Gender Inequality In order to solve the fundamentalproblem of reality and to realize gender equality, the gender perspective in theconstitutional equality discourse should be reflected and evaluated in legislative andnormative interpretation. The purpose of this study is to examine the past legislationactualizing the orders of ‘gender equality’ norms in the Constitution and thetendencies of interpretation on laws and figure out problems internalized in them. Also, this researcher aims to look into the meaning of ‘gender equality’ norms,reexamine its concrete realization in connection to the other principles or norms orvalues found in the Constitution, and discuss the directivity of it.
1. From the point that the ideal of the Constitution is to guarantee all humans’fundamental rights associated with human dignity, realization of value, freedom, orequality, we can make sure of the conceptual categories and indexes of genderequality norms. The pursuit of power inequality correction according to sexdifferences of ‘all individuals’ should be guaranteed by constitution, and specificgroups should not be excluded.
2. Concerning interpretation on the norms of equality, it is absolutely important tounderstand the sameness and difference and also the gap between legal equality andsubstantial equality. To narrow the gap, it is necessary to understand women who arethe objects of inequality in their viewpoint. In fact, it is practically impossible tohave a gender-neutral perspective, and it may even deepen or conceal the aspects ofgender inequality.
Meanwhile, if we try to look at how the provisions of the Constitution and related laws have been established previously as a way of realizing substantial equality, wecan find there are underlying male-dominant nationalism, protectionism, patriarchaltradition, culture, and custom, myth about strong maternal instinct, and ideology fornormal family completed with children. We can point out that the realization ofgender equality norms has been fixed and promoted within the frame actually. Regarding such ideologies mingled within the ideas of equality, we should justify ifthe current Constitution does really correspond to the other values we pursue. Moreover, unless it conforms to the realization of freedom and equality of thesubjects in the Constitution fundamentally, the directivity must be reestablished.
3. In realizing gender equality, the government’s roles and interventions arecrucial. It can be completed only when it is sought and practiced in close relationswith other principles of the Constitution, for instance, constitutionalism, social/nationalprinciples, or democracy. Particularly, it is more important than anything else toguarantee the right of the subjects of inequality to participate in politics and havetheir own voice, which means democracy is inseparable from gender equality.
