독일 통일과정상 공공재산 처리문제에 관한 소고 (A Study on Disposal Problems for Public Property during the Unification Process in Germany)

초록

한반도통일은 남북한 합의하에 평화적인 방법으로 추진되어야 하고, 무엇보다도 민족의 동질성 회복과 북한주민의 차별과 소외됨이 없도록 통일이 이루어져야 한다. 이를 위해서는 구체적인 입법적 준비가 필요하다. 특히 통일 이전의 공공재산에 관한 처리문제가 중요한 부분이다. 이런 점에서 통일독일의 경우는 동독정부의 보상 없는 수용에 대한 보상은 완전한 의미의 보상은 인정되지 않는다고 하였다.
다만 “공공자산 규칙을 위한 양독정부간의 공동성명서” 제2조에서는 “동독에서 탈주했기 때문에 또 다른 이유로 그의 재산이 국가관리로 이관된 시민들이 자기 소유권의 처분권을 되찾을 수 있다”고 규정하였다. 결국 구소유권자에게 소유권을 환원하기로 한 것은 장기적 측면으로 보면 타당하며 헌법상 권리인 재산권보장의 실현이지만 단기적 측면에서는 투자의 유보를 초래하였다.
한편 이러한 공공재산의 처리문제를 담당한 신탁청은 이후 수많은 실업을 야기하는 등 많은 부작용을 야기하였다. 1990년 통일 시점부터 1992년 말까지 불과 1년 반 사이에 신탁청 산하기업의 민영화 과정에서 발생한 실업이 구동독지역 전체실업 및 노동시장에서 퇴출된 경제인구의 75% 이상을 차지하는 것으로 나타나면서, 신탁청은 ‘일 없애는 기계’가 된 문제점을 드러냈다. 그리고 사유화과정에서 결국 2,000여억 마르크의 적자를 기록하였다. 이는 동서독 지역 간 경제 불균형을 초래하는 원인되었다. 그리고 화폐통합을 이루는 사이 동서독의 수많은 사람들이 동서독 환율차이를 악용한 불법편취를 함으로 인하여 신탁청의 업무도 과중하게 되었고 결국 통일이후 경제통합의 악영향을 야기하였다. 이는 통일독일의 성공에 큰 장애사유가 되어 실패한 통일이라는 비판이 이어오고 있다.
따라서 한반도 통일의 경우도 이러한 독일의 문제점들을 미리 입법적인 대비하고 있어야 하므로 공공재산의 처리에 관한 입법적 준비와 신탁청의 설립에 관한 입법적 준비 등이 필요할 것이다.

영어초록

It is obvious that unification of Korean peninsula should be proceeded with in a peaceful way under mutual consent. Above all, racial homogeneity should be recovered and integration should be done without discrimination and alienation for North Korean people. * Department of Law Graduate School Pusan National University, Ph. To do this, it would be essential to suggest its concrete implementation plans. Specially it is important to disposal problems for public property before the uni -fication. In this case of a unified Germany, it is not to recognize the compensation of the full meaning without compensate for the acceptance of the East German government.
However, the "Joint Statement between East and West Germany government for public property rules" in Article 2, it was regulated "Because he escaped from East Germany, for other reasons, the citizens of his property was transferred to the State Administration can regain the disposition of his property". Eventually, in the long term, it was reasonable decision to return the property to the former owners. but in short terms, led to hesitation of investment.
On the one hand, the Treuhandanstalt in charge of handling disposal problems for public property was causing a lot of side effects, such as causing a lot of unemployment.
From unification of 1990 until the end time of 1992, Unemployment in Trust Administration under the Treuhandanstalt's privatization process was found to account for more than 75% in the economy population of the former East German region's overall unemployment and withdrawn population in the labor market. the Treuhandanstalt revealed that the issues 'machine to eliminate employment'.
And in the privatization process, and eventually recorded a deficit of 200 billion mark. This was cause of economic imbalance between the East and West regions. and between forming a monetary union, a number of people in East and West Germany were due to illegal defraudation by exploiting differences in the exchange rate between East and West. and it caused heavily business of Treuhandanstalt. Eventually after reunification was causing the adverse effects of Economic Integration. this is a criticism of the failed unification because of the large disability reasons for the success of a unified Germany.
Therefore, in the case of the Unification of Korean peninsula, it should be prepared to prelegislation for these problems of Germany. And It will be required that the legislative preparation on the Disposal Problems for Public Property and the legislative preparation on the legislativ prepa -ration on the Establishment of Treuhandanstalt.
And one of the legislative measures be able to see it assumes the creation of an independent business supervision departments to supervise the fairness of the Treuhandanstalt.
By periodically performed with respect to whether or not there is a substantial supervision work Agency trust is made in step, that will complement problem of the Treuhandanstalt, such as the case of the German.
