민사집행법상 유치권의 공시에 관한 연구 (A Study on the Public Notice of Lien in Civil Execution Procedure)

초록

유치권은 등기부에 기재되어 공시되지 않고 점유만이 유일한 공시방법으로서 매우 불안정한 공시로 인하여 매수인은 인수해야 할 피담보채권의 범위에 대하여 파악하기가 사실상 어렵다. 이는 집행법원에 대한 유치권신고의무가 부여되어 있지 않기 때문에 부동산 경매에서의 매수인은 유치권의 성립여부를 알기가 어렵다는 문제점이 있다. 실제로는 허위·과장의 채권을 근거로 하는 유치권이 대부분임에도 불구하고, 유치권이 신고 되어 있다는 이유만으로 매수인들이 경매절차참여에 소극적이 되어 최저매각가격이 하락하고, 진실한 채권자들이 배당에서 불이익을 받을 뿐만 아니라, 채무자가 유치권자와 짜고 거액의 유치권신고를 한 후 부동산가격이 하락하면 제3자를 내세워 이를 다시 매수하는데 악용되는 등의 문제점이 있어 민사집행법상 이를 해결하기 위한 개선방안이 요구되고 있다. 부동산경매절차에 있어서 유치권의 근본적인 문제는 유치권에 대한 실질적인 심사와 유치권의 공시, 그리고 유치권자에 대한 정당한 배당의 인정여부가 관건이라고 할 수 있다. 따라서 유치권자의 신고의무를 강제하고, 허위의 유치권신고를 차단하기 위하여 피담보채권액의 일정부분을 보증금으로 공탁하게 하여 유치권의 등기제도를 마련하는 것이다. 이를 위해서는 매각물건명세서의 공신력이 담보되어야 하고, 민사집행법과 부동산등기법의 개정 등이 필요하다.

Lien is a legal collateral security to occupy other's object, keep the object till the redemption of credit, and compel the repayment of liabilities, and adopts the principle of undertaking, not that of cancellation. The one having lien can claim lien of the auction regardless of report of the right at competent court when the right occurs at corresponding object. When the one who claims lien during auction makes appearance, bidders are reluctant to bid. As a result, there are many cases that one makes wilful use of this, extends the auction period, and if the auctioning price falls, then makes a huge fortune by purchasing it at a low price. In addition, as reporting a lien in an auction process is not an obligation, such report can cause an auction price to go down and thus a person with a prior-order right to have loss due to the reduction of allotted fund. Meanwhile, if not reported, a buyer can unexpectedly bear additional performance responsibility of the secured credit of a lien as a loss. This Article aims the public notice of Lien in Civil Execution Procedure. And it is for investment strategies of real estate auction investors. As a solution to such problems of lien, we can think about revising the civil execution procedure. In order to prevent abuse of the lien system and establish an efficient real estate auction, it may be necessary to make open the information about occupation at the stage of appraisal or survey.
Above all, Public notice of lien is maintained only by occupation, so we should interpret the requirements for it's establishment strictly ; the corelation between the secured credit and the realestate narrowly, occupation by unlawful act widely, for the controlled and clarified establishment of real estate lien. It is necessary to introduce the deposit system. In case the lienor reports his rights and in case he is required to deposit the security money, it is expected that the report of false liens will reduce as the number of liens reported reduces.
