환경오염피해구제법상 구제급여에 관한 소고 (A Study of salvation fund by Act on Liability for Environmental Damage and Relief)

초록

2014년 12월 31일 제정된 “환경오염피해 배상책임 및 구제에 관한 법률”(이하 ‘환경오염피해구제법’이라 한다)이 2016년 1월 1일부로 시행되었다. 동법은 환경오염피해에 대한 배상책임을 명확히 하고, 피해자의 입증부담을 경감하는 등 실효적인 피해자를 구제하고자 하며, 환경오염피해로부터 신속하면서도 공정하게 피해자를 구제하고자 하는 목적을 가지고 있다. 환경오염에 대한 무과실책임, 배상책임보험의 의무화 및 구제급여 등은 동법의 큰 특징을 이루고 있다. 이 가운데 구제급여는 다른 국가의 환경법에서 흔히 볼 수 없는 독특한 성격을 지니고 있다. 구제급여란 피해자가 환경오염피해의 원인을 제공한 자를 알 수 없는 등의 사유로 환경오염피해의 전부 또는 일부를 배상 받지 못하는 경우 피해자나 유족에게 지급되는 급여를 의미한다. 환경오염피해구제법 제정으로 도입된 구제급여는 자동차손해배상보장법상의 보장사업과 매우 유사한 제도라고 생각된다.
환경오염피해구제법 제25조 제2항 및 시행규칙 제15조 제6항은 구제신청은 받은 날부터 30일 이내에 피해자 등이 구제급여의 지급요건이 적합한지 여부를 조사하는 예비조사의 결과를 피해자 등에게 통지하도록 하고 있다. 본 연구는 환경오염피해구제법상 특정한 사유로 말미암아 환경오염피해의 전부 또는 일부를 배상받지 못하는 경우에 피해자 등에게 환경오염피해의 구제를 위한 급여, 이른바 구제급여에 관한 내용, 구제급여 선지급 및 구제급여의 발생사유 등을 간략하게 고찰하고 있다.

영어초록

“Act on Liability for Environmental Damage and Relief” was legislated on 31 December 2014 (hereinafter “Environmental Damage and Relief Act”), and has been under implementation since 1 January 2016. The purpose of this Act is to provide an effective framework for remedying losses from environmental damage. Among others, its specific functions include clarifying liability on environmental damage and lightening the burden of proof that is to be undertaken by the victim.




“Salvation fund” is a payment made to either a victim or the family member(s) of the victim, who are not able to receive any compensation for environmental damage, for reasons including not being able to identify exactly who or what caused the environmental degradation. The “salvation fund,” which was introduced with the legislating of the Environmental Damage and Relief Act, is unheard of in other countries. It could be argued that the “salvation fund” is similar to the idea of “guarantee” under the “Guarantee of Automobile Accident Compensation Act.” In light of the Supreme Court’s ruling on the Guarantee of Automobile Accident Compensation Act, it could be said that the legality of “salvation fund” under the Environmental Damage and Relief Act could be equated with the claims right found in the Guarantee of Automobile Accident Compensation Act. This means that whoever requests the “salvation fund” carries the burden of proof, wherein the claimant must prove that he or she is entitled to receive the “salvation fund.” The Guarantee of Automobile Accident Compensation Act stipulates: “the Government may conduct investigations ex officio and compensate for damage sustained by the victim to the extent of an amount covered by liability insurance even if the victim has not filed a claim for damage.” In contrast, the Environmental Damage and Relief Act stipulates that the victim should file a claim to the office-in-charge, in order to receive the “salvation fund.” It must be noted that the Environmental Damage and Relief Act does not mention that the government may investigate and compensate the victim.




This paper seeks to provide an appropriate standard to be applied for deciding whether or not the claimant is entitled to receive the “salvation fund.” At the same time, it seeks to give suggestions for the standard operating procedure to be used for the preliminary screening and advance payment of the salvation fund.
