청와대 압수수색의 요건과 집행상의 문제 (Requirements for the search and seizure of ‘Blue House’ and the related issues of warrant enforcement)

초록

이 논문은 최근 「박근혜 정부의 최순실 등 민간인에 의한 국정농단 의혹 사건」에 대한 특별검사의 수사 과정에서 문제가 된 청와대에 대한 압수수색의 요건 및 집행상의 문제를 다루고 있다. 형사소송법 제110조 및 제111조에 따른 승낙 거부의 요건에 관한 해석론을 전개하였고, 현행법상 공무상 비밀 보호를 이유로 실체진실발견이 좌절되는 것을 막기 위한 입법론을 주장하고 있다.
금번 국정농단사건에서 대통령비서실장 및 경호실장이 청와대에 대한 압수수색을 거부한 것은 위법하다. 청와대라는 공무소의 장은 대통령인데, 당시 박근혜 전 대통령은 탄핵소추의 의결을 받아 권한이 정지된 상태였다. 대통령이 궐위된 경우 그 권한을 대행하는 자는 국무총리이므로, 청와대 압수수색에 대한 승낙을 거부할 수 있는 자는 당시 황교안 대통령 권한대행이다. 그러나 황교안 대통령 권한대행은 승낙 거부의 의사표시를 하지 않았다. 또한 대통령비서실장 등이 제시한 승낙거부의 사유는 형사소송법 제110조 및 제111조의 문언을 그대로 옮겨 놓은 것에 불과하여 무효이고, 박근혜 전 대통령이 대통령 재직 당시 특별검사의 수사를 수용하겠다는 점을 국민에게 밝혔음에도 불구하고 대통령비서실장 등이-설령, 승낙 거부의 권한이 인정된다고 하더라도-승낙을 거부한 것은 자의적인 승낙 거부로서 남용에 해당한다.
형사소송법 제110조와 제111조는 19세기 입헌군주국가의 사상적 배경을 지닌 조문으로서 오늘날 다원화된 민주주의 사회에는 적합하지 않은 규정이다. 현행법상 압수수색의 승낙거부의 주체를 정치적․행정적 책임을 질 수 있는 해당 장관으로 규정하고, 승낙 거부의 적법성을 판단할 수 있는 비공개심리절차를 특별검사에 의한 수사절차에 우선적으로 도입하는 방안을 검토하여야 한다.

영어초록

This paper deals with the requirements for the seizure and seizure of ‘Blue House’(Cheong Wa Dae, Presiential Office), which had been a serious problem in the process of the special prosecutor 's investigation on the case of Park-Geun-Hye and Choi Soon-sil scandal. I tried to develop the interpretation of the requirements of the denial of consent in accordance with Articles 110 and 111 of the Criminal Procedure Act and am insisting on the revision of the Criminal Procedure Act to prevent frustration of the truth-finding on the grounds of the secrecy of official affairs.
It was against the law to refuse consent for the seizure and seizure of the presidential secretary and the head of the security office on this case. The head of presidential office, ‘Cheong Wa Dae’ is the Korean president. At the time, former President Park Geun-hye was suspended due to the impeachment prosecution. So, who can refuse consent for the seizure and seizure of Blue House is the prime minister, Hwang Kyoahn, under the circumstance of the president’s vacancy. However, Mr. Hwang did not express his intention to deny acceptance. The reason for the refusal of acceptance is also invalid, because it just replaces the words of Articles 110 and 111 of the Criminal Procedure Act as it is, and even though former President Park Geun-hye has told the Korean people that she will accept the investigation of the special prosecutor at the time of presidency, it would be a arbitrary decision and abuse of authority that presidential secretary general refuses to accept the search and seizure of ‘Blue House’.
Articles 110 and 111 of the Code of Criminal Procedure are the provisions of the ideological background of the constitutional monarchy in the nineteenth century and are not suitable for today's diversified democratic society.
I suggest that the subject of the denial of acceptance of search and seizure search should be defined as the minister who can assume political and administrative responsibilities, and the consideration of introducing the ‘In-Camera-Procedure’, which can review the confidentiality of object of the search and seizure and the legality of denial of acceptance.
