상법상 공동해손 규정에 관한 연구 (Study on the Articles of General Average in the Korean Commercial Code)

초록

우리 상법상 공동해손 규정은 1962년 상법 제정 이후 계속하여 ‘해상’편에 존재해 왔다. 그럼에도 불구하고 상법상 공동해손 규정은 임의규정에 불과하여 실무적으로 거의 사용되지 아니하고, 선하증권 또는 용선계약에 편입된 1994년 요크-앤트워프 규칙이 공동해손의 성립 및 정산의 기준이 되고 있는 실정이다. 이는 1994년 요크-앤트워프 규칙이 해운업계에서 축적된 지식과 선박소유자와 적하이해관계인 간 국제적인 합의를 기준으로 마련된 결과 그 내용이 매우 상세한 반면, 상법상 공동해손 규정은 불과 11개 조문에 불과하고 그 내용이 매우 추상적이기 때문이다. 이에, 본 논문에서는 우선 1994년 요크-앤트워프 규칙과 상법의 공동해손 규정을 비교하여 그 이동(異同)을 분석한 후 현행 공동해손 규정의 개선 방안을 해당 부분에서 제안해 보기로 한다. 한편, 국제사법 제60조는 공동해손과 관련하여 선적국법주의를 채택하는바, 대한민국 선적의 선박에 공동해손이 발생할 경우 선하증권이나 용선계약에 1994년 요크-앤트워프 규칙이 편입되어 있지 아니하다면 상법 공동해손 규정이 적용 될 것이다. 그런데 공동해손의 성립 요건과 공동해손의 분담액 및 손해액의 산정 등 정산에 관한 상법상 모든 공동해손 규정이 당해 사안에서 적용될지 여부를 신중히 검토할 필요가 있다.

영어초록

The Articles in respect of the general average in the section of Admiralty of the Korean Commercial Code have existed since the first legislation of the Korean Commercial Code dated on 1962. However, despite of the long history of them, they are rarely used in the maritime practice due to their non-mandatory characteristics, and furthermore the York-Antwerp Rules 1994 incorporated into the bill of lading or charter party, have played the important role in the establishment and the effect of the general average. That's the reason that while the York-Antwerp Rules 1994 are based on the knowledge accumulated in the maritime business and the international agreement between the shipowners and the cargo interests, the number of Articles in respect of the general average in the Korean Commercial Code is nothing more than 11 with the result that the contents of them are very abstract. In this regards, I would like to analyze each Article in respect of the general average in the Korean Commercial Code in comparison with the York-Antwerp Rules 1994 and propose the idea for the improvement of the current Articles in the related parts. Followed by the analysis, I also note that the Article 60 of the Private International Law adopts the principle of the ship's nationality as regards the general average issue, and therefore the Articles in the Korean Commercial Code would be applied in the case that a ship of which nationality is the Republic of Korea sustains the general average, unless the York-Antwerp Rules 1994 is incorporated into the bill of lading or the charter party. However, it is necessary to review prudently whether or not the Articles related with both the requisite for and the adjustment of general average(including the calculation of general average and contributory value) in the Korean Commercial Code are applied in this case.
