농업식품기본법상 공익적 가치의 반영 (Reflections of the Public Interest Values in the Framework Act on Agricultural Food)

초록

헌법상 농업조항은 ‘농어촌의 지속 가능한 발전과 농어민의 삶의 질 향상’을 지향하고, 이를 달성하는 수단으로서 농어업·농어촌의 공익적 기능을 제고하는 것, 자연재해로부터 안심하고 농업에 종사할 수 있게 하여야 한다는 점, 수급균형과 가격안정, 유통구조 개선, 농지의 보전 등에 의하여 실현된다는 것이다.
이러한 내용들은 농업식품기본법에 조금 더 구체화된 이념적 추상적 규정으로서 충분히 반영되어 있어야 한다. 농업식품기본법은 86개의 개별 농업 관련 법률들의 모법으로서 법적 근거와 법해석의 기준이 되기 때문이다. 개별 농업법에 구체적인 시행규정이 없다면, 기본법의 이념과 취지에 따라 기본법을 직접 적용할 수도 있다. 물론 지방자치단체가 헌법과 기본법의 취지에 반하지 않는 범위에서 조례를 제정하여 시행할 수도 있지만, 그 시행에 있어서는 언제나 논란거리가 될 수 있다.
농업·농촌의 공익적 가치가 농업식품기본법에 충분히 반영되었는지를 살펴보면 그렇지 않다는 것이고, 농촌의 중요성이 강조되는 현시대에 고령화, 기후변화, 농촌소멸 등의 농촌현안 문제와 인간다운 삶을 위한 환경보존의 중요성은 두말할 필요성이 없다. 이러한 문제를 해결하는 단초로서 우선 농업식품기본법에 농업·농촌의 공익적 가치를 충분히 반영하는 개정작업이 요구된다고 하겠다.
연구결과를 요약하면, 첫째 기본법의 목적에 농업과 농촌의 공익적 기능에 관한 내용이 없다. 공익적 기능을 강화하는 것은 국민의 삶의 질 향상에 지대한 영향을 미친다. 따라서 이를 반영할 필요성이 있다.
둘째, 기본이념에 농지에 관한 언급이 빠져 있다. 농지의 기본원칙은 헌법 제121조 제1항에 따라 경자유전의 원칙이다. 이것은 구체적으로 농지법 제6조 제1항에 의하여 구현된다. 농업은 농업·농촌의 공익적 기능을 바탕으로 농업인의 삶의 질 향상 및 국민의 삶의 질 향상을 위하여 안전한 농산물을 안정적으로 공급하는 기능을 담당해야 한다. 셋째, 기본이념에 농업의 발전방향, 농촌의 발전방향, 농업인의 역할, 식품산업 육성 등 핵심적 내용을 명확히 규명할 필요가 있다.
넷째, 농업농촌의 공익적 기능을 열거함에 있어서 보다 포괄적인 규정으로 개정할 필요가 있다. 농촌 및 산촌의 유지·보전, 도시인의 치유기능 증진 등 다양한 공익적 기능이 개발될 수 있으므로, 열린 규정으로 입법화되어야 할 것이다.
다섯째, 농업농촌의 공익적 기능이 국가의 균형발전과 국민의 식생활 향상에만 맞추어져 있다. 공익적 기능은 국가의 균형발전과 국민의 식생활 향상 외에도 다양하게 창설될 수 있는 것이므로 열린 예시규정으로 개정해야 할 필요성이 있다. 공익적 기능은 기왕의 기능을 유지·증진하는데 그치는 것이 아니라 지역특색에 맞게 개발될 수도 있는 것이다. 따라서 ‘개발’을 추가할 필요가 있다.
여섯째, FTA 등 개방화시대에 WTO체제가 허용하는 허용보조로서 직불금지급이 세계적 추세임에 비추어, 이러한 내용이 기본법에 담겨 있지 않는다는 것은 문제이다. 따라서 직불금 지급근거를 마련하는 것이 필요하다고 할 것이다. 생산연계 직불금을 지급하던 것이 공익적 기능을 강화한 농촌의 관광자원화, 미래로 나아가서는 전원생활의 공간의 가치를 통한 공익적 직불금으로 전환할 것으로 예측된다.

영어초록

Under the Constitution, the clause on agriculture should be realized by aiming for "sustainable development of farming and fishing villages and improving the quality of life for farmers and fishermen" and enhancing the public service functions of farming and fishing villages as a means to achieve them, allowing them to engage in farming with confidence from natural disasters, balancing supply and demand and stabilizing prices, improving distribution structure, and preserving farmland.
These content should be fully reflected as ideological and abstract rules that are more specific to the Framework Act on Agricultural Food. This is because the Framework Act on Agriculture and Food is the parent law of 86 individual farming-related laws and serves as the basis for legal grounds and interpretation of the law If there are no specific enforcement provisions in the individual farming laws, the basic laws may be applied directly according to the ideology and purpose of the Basic Law. Of course, local governments may enact and implement ordinances to the extent that they do not run counter to the purpose of the Constitution and the Basic Law, but they can always be controversial in their implementation.
It is needless to say that the public value of farming and farming villages has been fully reflected in the Framework Act on Agriculture and Food, and the importance of environmental preservation for human life is important to the current era of aging, climate change, and eradication of rural areas. As a starting point for solving these problems, the Framework Act on Agriculture and Food calls for a revision of the Act, which fully reflects the public interest values of farming and farming villages.
To summarize the research results, there is no content on the public service functions of agriculture and rural areas for the purpose of the first basic law. Strengthening the function of the public interest has a profound effect on improving the quality of life of the people. Therefore, there is a need to reflect this.
Second, the basic idea is missing the mention of farmland. The basic principle of farmland is the principle of light-liberation warfare in accordance with Article 121 paragraph 1 of the Constitution. This is specifically implemented under Article 6 paragraph 1 of the Farmland Act. Agriculture should be in charge of providing safe agricultural products in a stable manner for improving the quality of life of farmers and improving the quality of life of the people based on the public service functions of farming and farming villages. Third, it is necessary to clearly identify key contents such as direction of development of agriculture, direction of development of rural areas, role of farmers, and promotion of food industry in basic ideology.
Fourth, it is necessary to revise it to a more comprehensive regulation in listing the public-interest functions of farming and farming villages. Various public-interest functions, such as the maintenance and preservation of rural and mountain villages, and the enhancement of the healing functions of urbanites, can be developed, so they should be legislated with open regulations.
Fifth, the public service function of farming and farming villages is geared only to balanced development of the country and improvement of the people's diet. Public service functions can be created in addition to balanced national development and improvement of the people's diet, so there is a need to revise them into open illustrative regulations. The public service function is not only to maintain and enhance the function of the flag, but it can also be developed to suit local characteristics. Therefore, it is necessary to add "development."Sixth, in light of the global trend of direct payment as a permitted subsidy by the WTO regime in an era of openness, such as the FTA, it is a problem that such information is not contained in the basic law. Therefore, it will be necessary to establish the basis for direct payment. It is predicted that the payment of production-linked direct payment will be converted into a public-interest direct payment through the value of rural tourism resources that have strengthened public service functions, and the value of rural life in the future.
