인권조약상의 정보접근권에 관한 소고 (A Study on the Right of Access to Information in International Human Rights Treaties)

초록

이 글은 국제인권법적 차원에서 공공기관이 보유하고 있는 정보에 접근할 권리로서 정보접근권의 보장 및 완전한 실현을 위한 기준을 마련하기 위해 주요 인권조약이 이 권리를 어떤 방식으로 인정하고 있는지에 관한 연구이다. 이를 위해 먼저 정보접근권의 개념을 간단히 검토하고 그 다음으로 인권조약과 그 감시기관이 정보접근권을 인식하는 방식을 살펴보았다.
자유권위원회 및 지역인권재판소들은 이들 조약의 해석과 개별 사건에서의 판단을 통해 정보접근권을 인정해왔다. 주로는 표현의 자유, 공무에의 참여에 의거하여 이 권리를 인정하였고 이 외에도 공정한 재판을 받을 권리, 프라이버시권의 권리보장을 위해 필요한 수단으로서 정보접근권을 인정했다. 뿐만 아니라 최근에는 경제적․사회적 권리에 근거한 정보접근권의 성립을 주장하기도 한다.
인권의 불가분적이고 상호의존적인 특성을 강조할 때, 정보접근권은 사실상 인권조약상 존재하는 모든 권리 목록의 보호와 실현을 위한 필수 도구로서 가치를 가지며, 인권조약상 보장하는 인권으로서 확립되었다는 점에 대해 더이상 큰 이견이 없다. 문제는 정보접근권을 인권조약상의 다른 권리에 의거하여 인정함으로 인하여 정보접근권을 원용할 수 있는 상황, 원용가능한 정보의 성격, 정보의 접근을 추구하는 목적, 정보 청구인 자격 등에 관한 제한이 발생한다는 점이다. 이러한 제한들은 정보접근권의 완전한 실현을 어렵게 만든다.
정보접근권의 현재의 국제적 논의의 한계를 극복하기 위해서는 정보접근권을 도구적 권리로서 뿐만 아니라 내재적 권리로서 인정해야 하며, 이를 위해 우선적으로 유엔 총회 결의나 또는 국가들의 정치적 선언을 통해 내재적 인권으로서 정보접근권을 인정할 필요가 있다.

영어초록

This article is a basic study on the protection or realization of access to information, as a right of access to information held by public authorities, in the context of international human rights law. First, the concept of right of access to information is reviewed. briefly. Second, the article examines the relevant provisions of the human rights treaty and how the right of access to information is realized. This study was conducted in the context of major human rights treaties such as the International Covenant on Civil and Political Rights, the European Convention on the Protection of Human Rights and Fundamental Freedoms, the American Convention on Human Rights, and the African Charter on the Rights of Man and People.
The human rights treaty bodies and the regional human rights courts have recognized the right of access to information by interpretation of treaties and judgments in individual cases. The CCPR Committee and the regional human rights courts have recognized this right based on other rights, i.e., freedom of expression and participation in official affairs, as well as the right to fair trial and the right to privacy. Recently, it has been argued that the right of access to information should be established based on economic and social rights. Stressing the indivisible and interdependent nature of human rights, the access to information is invaluable as an essential tool for the protection and realization of all other rights. It is clear that the right of access to information is a human right guaranteed by major human rights treaties.
The problem is that the establishment of the right of access to information is restricted by recognizing such rights as an instrument for protecting other rights. These restrictions make the full realization of the right of access to information difficult. In order to overcome the limitations of the present discussion of the right to access information in the international dimension, it is necessary to develop a right of access to information as an inherent right as well as an instrumental right.
