국제사법상 어음․수표 관련 규정에 관한 소고 (Review of Provisions for Bills and Checks under Private International Law Act)

초록

국내 전자지급결제시스템의 급속한 발전과 더불어 국제적인 지급결제시스템 또한 IT 기술의 발전에 힘입어 종래보다 빠르고 저렴하게 국가 간 송금이 가능한 환경이되었다. 이에, 과거와 달리 국제적인 거래에서 지급결제수단으로 사용되던 환어음의 사용 또한 이를 이용할 유인이 상당히 사라졌다. 그리고 여행자수표를 제외하고 수표는 국내용으로 사용되는 것이 일반적이고, 수표를 국제적으로 사용할 이유 또한 상당히 줄어든 것이 사실이다. 그러나 여전히 환어음을 국제적으로 사용하는 예가 있고, 여행자수표 또한 사용례가 있다는 점에서 우리 국제사법에서 규정하는 국제어음법 및 국제수표법과 관련한 충분한 이해가 필요하다.
그러나 우리 국제사법상 어음․수표와 관련한 국내의 관심과 연구는 일천하다. 이는 어음법과 수표법을 담은 실질법 교과서는 물론이고, 국제사법과 관련한 교과서에서도 동일하다. 관련 연구논문을 찾기도 어려울 정도이다. 우리 국제사법상 어음․수표 관련 조문은 1930년 및 1931년 제네바 어음․수표저촉법협약에 기초한 것이지만 이 협약들에 관한 국내 연구논문은 전무하고, 국제적으로도 논문이 많지 않은 실정이다. 국제사법의 준거법 관련 연결규칙은 국제적 판단의 일치라는 국제사법적 정의를 추구하기 위한 것인데, 이 점에서 국제협약을 잘 녹여내어 이를 우리 국제사법에 반영한 것은 칭찬받을 일이나, 이에 대한 해석을 어떻게 해야 하는 것인지는 결국 학계와 법원의 임무이다. 그간 어음․수표와 관련한 국제사건이 많지 않았기 때문에 이에 관한 연구 필요성이 많지 않았을 것이고, 이 분야의 연구자가 극히 부족한 것도 그간 관련 연구가 부족하였던 원인이라고 생각한다. 그렇다고 하더라도 우리 국제사법상 어음․수표와 관련한 조문의 정확한 이해와 그 조문이 기초하는 논리를 연구할 필요성은 여전하다.
이에, 이 글에서는 우선 제내바어음저촉법협약 및 제네바수표저촉법혁약의 연혁을 소개하고, 다음으로, 이 글의 본론으로서 국제사법상 국제어음법과 국제수표법을 규정하는 제79조부터 제88조까지를 조문별로 해석론을 제시하여 향후 이 분야와 관련한 국제사건에서 관련 조문의 이해를 돕고, 추가적인 연구의 실마리를 제공하고자 한다.

영어초록

With advance of the rapid development of electronic payment methods in Korea, international payment methods have also improved thanks to advances in the IT technology, making it possible to cross-border fund transfer between countries faster and cheaper than ever before. Therefore, unlike in the past, the use of bills of exchange, which were used as a payment method for international trades, has largely disappeared. It is also true that checks, with the exception of traveler's checks, are usually used for domestic purposes, and the reasons for using checks internationally have considerably diminished. However, there are still examples of international use of bills of exchange, and traveler's checks are still used, so that it is necessary to properly understand the private international law aspects of bills of exchange, promissory notes and checks.
However, there are only few domestic studies on bills and checks under the Private International Law Act of Korea. This is true not only for substantive law textbooks covering the law of bills and checks, but also for textbooks on private international law. It is also difficult to find relevant legal articles. The bills and check provisions of Korean PIL Act are based on the Geneva Bills and Promissory Note Convention and the Geneva Check Convention, but, unfortunately, there are no domestic research papers on these conventions and only few international papers. The conflict of laws are intended to pursue the international justice of uniformity of judgment, and in this respect, there is no problem in incorporating international Conventions into the Korean PIL Act. However, how to interpret them is ultimately the task of academics and courts. Since there have not been many international cases involving bills and checks, there has not been much need for research, and I believe that the lack of researchers in this field is also a reason for the lack of due research. Nevertheless, there is still a need to study the precise understanding of the provisions related to bills and checks in the Korean PIL Act and the logic on which they are based.
Therefore, this article first briefly introduces the history of the Geneva Conventions; then, it examines Articles 79 through 88 of the Korean PIL Act which provides for the connecting factors of bills and checks in order to offer due understanding of the relevant provisions and to provide clues for further research; finally, concluding remarks are drawn.
