행정절차법상 청문주재자에 관한 연구 (A Comparative Study on the Presiding Officers of Hearings in Administrative Procedure Act between America and Korea)

초록

대부분 나라들은 행정절차법에 청문에 관한 규정을 두고 있다. 청문은 국민의 자유․권리를 제한․침해하는 행정처분을 발하기 전에 행정청이나 관계인의 주장․증거에 대하여, 처분의 상대방이나 대립하는 이해관계인으로 하여금 자기에게 유리한 주장·증거를 제출하여 반박할 수 있는 기회를 부여함을 목적으로 하는 절차이다. 공정한 청문을 보장하여 상대방의 권리를 보호하고 방어하기 위해서는 청문주재자의 역할이 중요하다. 미국의 행정절차법은 전 세계의 행정절차법의 모델이기도 하고 청문주재자의 입장에서 보면, 미국보다 행정절차의 공정성을 철저하게 추구하는 나라는 없다. 미국은 청문주재자로 행정법판사를 두어 직무수행의 독립성, 전문성, 자율성, 공정성을 확보함으로써 청문의 상대방을 최대한 보호하고 있다. 즉 변호사 자격이 있는 사람을 청문주재자로 한다는 점, 직무에 있어 조사기능과 소추기능을 분리하는 점, 청문주재자의 소속기관과 선정기관이 다른 점, 직무의 독립성이 보장되는 점, 철저하게 신분보장이 이루어지는 점, 제척․기피․회피를 인정하는 점, 판사행동강령을 따르는 점 등 여러 방법이 강구되고 있다. 미국과 우리나라는 법체계가 다를 뿐만 아니라 미국은 절차법이 중시되고, 우리나라는 실체법이 중시되는 점 등에서 큰 차이가 있지만 우리나라의 행정절차법은 미국의 행정절차법을 모델로 제정되었다. 우리나라도 청문의 공정성 확보를 위한 청문주재자에 관해 여러 가지 제도적 장치를 마련하고 있지만 미국의 행정법판사제도에 비추어 볼 때 개선할 점이 있다. 그러한 점에서 우리나라의 청문주재자제도의 개선은 미국의 행정법판사제도의 연구를 통해 그 시사점을 찾을 수 있을 것이다.

영어초록

Our administrative procedure act states the term “hearing”means the procedure under which an administrative agency directly hears the opinions of concerned parties, etc. and investigates evidence before issuing a disposition (Article 2 (5)), and by extension, the law provides presiding officers of hearings that hearings shall be presided over by persons designated by administrative agencies from among either their personnel or persons holding a qualification prescribed by Presidential Decree, and administrative agencies shall endeavor to ensure fairness in the designation of presiding officers of the hearings (Article 28(1). They are called Administrative Law Judge (ALJ) in U.S. Administrative Law Act (APA).
Presiding officers of hearings preside over agency hearings with fairness and impartiality. According to the fair and impartial hearings, presiding officers of hearings make an initial decision that would become the decision of agency without proceedings unless there is an appeal to, or review on motion of, the agency within time provided by rule. Therefore, residing officers of hearings play an important role in protecting the interests of complaints by regulating the processes of hearings.
However, there are some different in presiding officers of hearings between two countries. As mentioned above, we have presiding officers of hearings to regulate the hearings in Administrative Procedure Act like ALJs, and the dependence of them from the agency is much weaker than that of ALJs.
The dependence of ALJs from the agency and the separation and functions, appoint and sanction, quality standard to be appointed, current situation of ALJs etc., are ensured under the enabling acts and the Federal APA.
Therefore, our administrative procedure act needs to be improved as follows. First, a government agency must employ the qualified person as presiding officers of hearings. Second, the qualification of presiding officers of hearings must be strengthened and the status of presiding officers of hearings and independence on their works should be supported. Third, hearing results of the presiding officers of hearings should be reflected in administrative disposition. Forth, our presiding officers of hearings should be applied a Code of Judicial Conduct.
