중국의 중재절차상 보전처분에 관한 연구: ‘중국과 홍콩 법원의 중재절차상 상호 보전처분에 관한 규정’을 중심으로 (A Study on the Preliminary Disposition in China’s Arbitration Procedures: Focusing on the Regulations on Mutual Preliminary Disposition in Arbitration Procedures of Chinese and Hong Kong Courts)

초록

본 논문은 중국 영토이기는 하지만 독립된 사법권을 가지고 있는 홍콩과 중국 간에 합의로 제정된 ‘중국과 홍콩간 보전처분규정’과 중국의 보전처분관련 법규를 확인하여, 중국이 외국중재판정부가 내린 임시적 처분에대해 어떠한 태도를 보이고 있는지를 간접적으로 확인하였다. ‘중국과 홍콩간 보전처분규정’은 중재절차중에 당사자는 직접 법원에 보전처분을 신청할 수 있으며, 또한 중재판정부를 통해 법원에 보전처분을 신청할 수있다고 규정하였고, 그리고 중국 중재법 및 관련 사법해석은 중재절차가진행되는 동안에 중재 당사자는 중재판정부를 통해서만 법원에 보전처분을 신청할 수 있다고 규정하였다.
이처럼 상기 법규 모두는 당사자가 법원에 직접 보전처분을 신청할 수있는지와 관련한 차이를 제외하고 중재절차중에는 법원만이 보전처분을내릴 권한을 가지고 있음을 규정하고 있다. 그러나 UNCITRAL 모델중재법을 포함한 대부분의 중재관련 법규는 중재절차가 진행되는 동안에도 당사자는 중재판정부에 임시적 처분을 신청할 수 있으면, 또한 법원에도 보전처분을 신청할 수 있다고 규정하고 있다. 이는 중재판정부의 임시적 처분이 비록 법원의 보전처분에 비해 실효성 측면에서 일정한 한계가 있을 지라도, 두 기관 모두에게 보전처분 권한을 부여하여 피해가 예상되는 당사자를 중첩하여 보호하고자 하는 의도에서 규정된 것이라 할 수 있다. 그러나 중국은 보전처분의 집행권이 법원에 있고 중재판정부의 임시적 처분은 중재판정부가 구성된 이후에나 이용이 가능하다는 등의 이유를 들어중재판정부의 임시적 처분 권한을 인정하지 않고 있으나, 이는 국제적으로 인정되고 있는 중재판정부의 임시적 처분의 실효성을 과소평가한 것으로 보인다.

영어초록

This paper verifies indirectly what kind of attitude China is showing about interim measures by Foreign Arbitral Tribunal through verifying the 'Regulations on preliminary disposition between China and Hong Kong' established by agreement between China and Hong Kong, which has independent judicial powers even though it is Chinese territories, and Chinese laws related to preliminary disposition. The "Regulations on preliminary disposition between China and Hong Kong" stipulates that during the arbitration process, the parties may apply directly to the court for a preliminary disposition, or through the arbitral tribunal to the court. During the arbitration proceedings, the parties to the arbitration may apply to the court for a preliminary disposition only through the arbitral tribunal.
As such, all of the above regulations stipulate that only the court has the authority to preliminary disposition during the arbitration proceeding, except for the difference in whether the parties can directly apply for a preliminary disposition to the court. However, most arbitration-related laws, including the UNCITRAL Model Arbitration Act, stipulate that even during an arbitration proceeding, a party may apply to the arbitral tribunal for an interim measure, and may also apply to the court for a preliminary disposition. Even though the arbitral tribunal's interim measures has certain limitations in terms of effectiveness compared to the court's preliminary disposition, it is stipulated with the intention of overlapping and protecting the party who is expected to be harmed by granting the authority to preliminary disposition to both institutions. However, China does not accept the arbitral tribunal's power to enforce interim measures on the grounds that the court has the power to enforce preliminary disposition and that the arbitral tribunal's interim measures are available only after the arbitral tribunal is formed, but it appears to have underestimated the effectiveness of the arbitral tribunal's interim measures
