고령사회에서 민법상 부양에 관한 고찰 (A Study on the Duty of Support under Civil Law in an Aging Society)

초록

고령사회로의 진입에 따른 부양 문제는 현대사회가 해결해야 할 중요한 과제이다. 고령사회에서 부모 부양의 문제는 법적, 제도적으로는 여전히 미비한 점이 많아 여전히 체계적인 대응이 부족하다. 사회 구조의 변화는 부모와 자녀 간의 가족 중심 부양 방식의 전통적인 부양 방식에 변화를 불러왔다. 생산가능인구의 감소, 부양이 필요한 고령인구 증가, 노년부양비의 지속적인 증가는 젊은 세대의 경제적 부담을 가중시키고, 세대 간 갈등으로 이어진다.
민법상 부양의무는 1차 부양의무(생활유지의무)인 부부 상호 간 부양의무와 부모의 미성년자녀에 대한 부양의무와 2차 부양의무(생활부조의무)인 친족 사이와 성년 자녀에 대한 부모의 부양의무, 성년 자녀의 노부모 부양의무로 나눌 수 있다.
고령사회에서의 부모 부양과 관련된 문제의 해결책으로 첫째 노인 부양 인식의 변화, 고령자 단독 가구의 증가로 인한 노인 부양 문제는 국가와 사회의 적극적 개입을 요구한다. 둘째 성년 자녀의 부양의무이행을 확보하기 위한 방법으로 부양의무를 민법에 규정하여 근거를 마련하거나, 국가가 먼저 부양하고 구상을 청구하는 방법 등이 있다. 셋째 직계혈족 및 그 배우자 간에서 직계혈족의 배우자라는 이유만으로 부양의무를 인정할 이유는 없다. 또한 국민 인식의 변화에 따라 생계를 같이하는 기타 친족을 생계를 같이 하는 친족 또는 특별한 사정이 있는 경우 3촌 이내의 친족으로 개정하고, 넷째 공적부조를 강화하여 고령자의 노후생활 안정과 세대 간 갈등 완화를 도모해야 한다.

영어초록

The issue of elder care resulting from the transition to an aging society is a significant challenge that modern society must address. In an aging society, the issue of caring for elderly parents remains inadequately addressed both legally and institutionally, and systematic responses are still lacking. Social structural changes have altered the traditional family-centered approach to elder care between parents and children. A decrease in the working-age population, an increase in the elderly population requiring care, and the continuous rise in the old-age dependency ratio intensify the financial burden on younger generations and lead to intergenerational conflict.
Under the Civil Act, obligations of support can be divided into primary support obligations (duty to maintain livelihood), which include mutual support between spouses and the duty of parents to support their minor children, and secondary support obligations (duty of livelihood assistance), which include obligations between relatives and the duty of adult children to support their parents, and vice versa.
To resolve issues related to elder care in an aging society: First, there must be a shift in perceptions about elder support. With the increase in elderly people living alone, the issue of elder care requires active intervention from the state and society. Second, in order to ensure that adult children fulfill their support obligations, it is necessary to establish a legal basis within the Civil Act or adopt a system in which the state provides support first and then seeks reimbursement. Third, among lineal ascendants and their spouses, the spouse of a lineal ascendant should not be deemed obligated to provide support solely due to their marital connection. In response to changing public perceptions, the definition of relatives living together for the purpose of support should be revised to include those within the third degree of kinship or in special circumstances. Fourth, public assistance should be strengthened to ensure the stable livelihood of the elderly and alleviate intergenerational conflict.
