초록

현행 헌법 제36조 제1항이 ‘양성의 평등’을 규정하고 있기 때문에, 헌법에 혼인에 관한 명문규정이 없는 다른 나라와 동성혼을 직접 비교할 수는 없다. 동성혼 허용과 관련하여, 헌법 제36조 제1항의 규정만으로 ‘동성혼이 허용될 수 있다 또는 없다’는 서로 다른 주장은 어느 쪽으로의 가능성도 부인하지 않는다. 현행 헌법이 혼인제도에 관하여 남녀의 결합만을 인정하고 있다고 소극적으로 해석할 수 있지만, 헌법해석은 사회적 변화와 흐름을 수용하고 이를 통해 사회가 나아갈 방향을 제시하여야 한다는 점에서 적극적 해석도 가능하다. 동성혼의 허용여부는 - 근본적으로 - 헌법해석의 문제라는 것을 재차 강조하지 않을 수 없다.
동성혼 허용여부는 개인간의 가치․신념의 충돌, 크게는 문화와의 갈등이다. 동성혼은 서양의 문화의 문제이지 동양의 문화에는 맞지 않다고 주장하는 사람도 있다. 우리 국민들의 일반적인 인식은 이들에 우호적이지 않다. 개인지향적 서양사회는 타인의 삶에 무관심하다. 그러나 공동체지향적 동양사회는 타인의 삶이 나에게도 영향을 미치고 나의 관심의 대상이 된다. 동양문화 속에서는 동성혼도 모든 국민의 관심대상이 될 수밖에 없고, 국민의 법감정은 동성혼에 대해서 아직은 호의적이지 않다. 동성혼에 대한 사회적 인식의 변화를 위하여 적극적으로 노력할 필요가 있다. 혼인에 대한 사회통념이나 국민의 의식, 가치관은 언제나 변할 수 있기 때문이다.
정상가족의 관점에서는 혼인은 남녀간의 결합이지만, 인간의 삶에 정답은 없다. 가족을 꾸리는 법도 마찬가지이다. 현실에 존재하는 수많은 가족의 형태를 그래도 인정하자. 혼인도 그렇다. 이성간의 결합뿐 아니라 - 우리 사회에 해가 되지 않는다면 아니 오히려 이익이 되는 ‘생활공동체’ 또는 ‘영속적 유대’라는 관점에서 - 동성 간의 결합도 혼인으로 인정하자.
그러나 그것이 우리의 문화와 전통의 관점에서 수용될 수 없다면, 혼인유사제도(‘파트너쉽’ 내지 ‘생활동반자관계’)의 틀에서 - 헌법 제10조에 기초하여 - 동성커플에 대한 중간 단계의 보호 장치라도 적극적으로 검토할 필요가 있다. 다양성을 존중하는 민주주의 정신, (성)소수자를 보호하려고 하는 기본적의 본질적 성격을 간과할 수는 없다. 이미 세계 각국은 동성커플에 대한 법적 보호를 인정하는 추세이다.

Let us still acknowledge the numerous types of families that exist in reality. The same goes for marriage. Let us recognize not only unions between opposite sexes but also unions between same-sex people as marriage - from the perspective of a ‘living community’ or ‘permanent bond’ that is beneficial if not harmful to our society.
However, if it is not acceptable from the point of view of our culture and tradition, even if it is an intermediate level of protection for same-sex couples in the framework of a marriage-like system (‘partnership’ or ‘life partnership’) - based on Article 10 of the Constitution - There is a need to actively review it. The spirit of democracy that respects diversity and the basic essential nature of protecting (sexual) minorities cannot be overlooked. Countries around the world are already recognizing legal protection for same-sex couples.
