과로자살의 업무상 재해 인정과 심리부검 활용 (A Study on the Use of Psychological Autopsies in Recognition of Occupational Accident of Overwork Suicide)

초록

본 연구는 과로와 과로자살의 개념을 정립하고, 과로자살의 업무상 재해 인정절차에서 효율성을 강화하기 위해 심리부검을 활용하는 방안을 제시하는 데 연구의 목적을 두었다.
‘과로’란 장시간 노동뿐만 아니라 심리적 부담을 포함하는 개념으로서 ‘업무상의 과중한 신체적･심리적 부담으로 건강장애가 발생한 상태’로 정의하였고, ‘과로자살’이란 ‘업무상의 과중한 신체적･심리적 부담으로 건강장애가 발생한 상태에 기인한 자살’이라고 정의하였다.
과로자살의 업무상 재해 인정절차는 조사절차와 판정절차로 이원화되어 있고, 재해조사는 근로복지공단 지사에서 진행하고 판정은 업무상질병판정위원회에서 하고 있다. 하지만 조사 담당자의 전문성이 부족하고, 조사방식에 한계가 있다. 그러므로 독일과 프랑스처럼 보험담당 행정기관이 직접 조사하지 않고 별도의 전문가에게 조사를 의뢰하는 것이 필요하고, 그런 측면에서 심리부검 활용에 대한 적극적인 검토가 요구되고 있다. 육체적 질병으로 사망하였으나 사인미상인 경우 신체부검을 하듯이, 자살의 사회심리적 원인이 명확하지 않은 경우 심리부검을 실시할 필요가 있다.
업무상 자살 재해조사에 심리부검을 활용하고자 하는 선행 연구에서는 심리부검에서 실시하는 조사내용이 일반적이어서 업무상 자살조사에는 적합하지 않다고 보았다. 하지만 중앙심리부검센터에서 시행하는 직업관련 스트레스 조사항목이나 근로복지공단에서 실시하는 업무상 스트레스 조사항목이 큰 차이가 없으므로, 심리부검을 통해서 업무관련 자살의 조사 진행이 충분히 가능하다는 것을 확인했다. 그러므로 심리부검은 자살의 업무상 재해 판단이 이루어진 이후의 유족지원 사업 방안으로 진행될 것이 아니라 재해조사 과정에 연계하여 진행하고 사후까지 연결하는 방식이 타당하다고 본다.
현 단계에서 심리부검을 활용하는 방법은, 근로복지공단에서 재해조사 시작단계부터 중앙심리부검센터에 심리부검을 의뢰하는 형태로 진행하고, 차후에 업무상 자살 관련 심리부검 의뢰가 많아지고 경험이 축적되면, 고용노동부 산하에 심리부검센터를 설립하는 것이 필요하다고 본다.
또 다른 형태는, 산업안전보건법상의 역학조사를 활용할 수도 있다. 정신질환이나 자살에 대해서도 심리부검을 통해 역학조사를 할 수 있다는 규정 신설이 필요하고, 구체적인 대상과 절차 등에 관한 연구가 진행되어야 할 것이다.

영어초록

The purpose of this study was to establish the concept of overwork suicide, and to suggest ways to utilize psychological autopsy to strengthen efficiency in the procedure for recognizing occupational accidents of overwork suicide.
Overwork is a concept that includes psychological burdens as well as long hours of work, and ‘overwork suicide’ was defined as ‘a state in which health disorders occurred due to heavy physical and psychological burdens on work’.
The procedure for recognizing an occupational accident of overwork suicide is divided into an investigation procedure and a judgment procedure, and the accident investigation is conducted by the Labor Welfare Corporation branch and the judgment is made by the Occupational Disease Judgment Committee. However, the expertise of the investigator is insufficient, and there is a limit to the method of investigation. Therefore, it is necessary to request an investigation from a separate expert without direct investigation by the administrative agency in charge of insurance, such as Germany and France, and in this respect, active review of the use of psychological autopsy is required. It is necessary to conduct a psychological autopsy if the social psychological cause of suicide is not clear, just as a physical autopsy is performed in the case of death from a physical disease but unknown cause of death.
In previous studies to use psychological autopsy for occupational suicide accident investigations, the contents of the psychological autopsy were general, so it was not suitable for work-related suicide investigations. However, there is no significant difference between the job-related stress survey items conducted by the Central Psychological Autopsy Center and the work-related stress survey items conducted by the Korea Workers' Compensation and Welfare Service. Therefore, it is reasonable to conduct a psychological autopsy in connection with the disaster investigation process and connect it to the post-mortem, rather than as a plan to support the bereaved family after the occupational accident judgment of suicide is made.
The method of using psychological autopsy at this stage is to request psychological autopsy from the beginning of the disaster investigation to the Central Psychological Autopsy Center, and to establish a psychological autopsy center under the Ministry of Employment and Labor.
Another form may be to use epidemiological investigations under the Occupational Safety and Health Act. It is necessary to establish a regulation that epidemiological investigations can be conducted on mental illness or suicide through psychological autopsy, and research on specific subjects and procedures should be conducted.
