「부동산등기 특별조치법」상 검인제도의 개선방안에 관한 연구 (A Legal Study on the Improvement of the Seal System under the Act on Special Measures for the Registration of Real Estate)

초록

현행「부동산등기 특별조치법」상의 검인제도는 부동산소유권의 이전등기신청을 의무화하고, 부동산투기수단으로 이용되는 허위 또는 부실등기의 신청행위나 부동산투기를 억제하기 위한 제한법령을 회피하는 여러 편법적이고 탈법적인 행위를 직접 규제한다. 이 제도를 통해 기재된 등기부상 내용과 거래의 실제 내용을 일치시킴으로서 종국적으로는 건전한 부동산거래질서를 확립시킬 수 있도록 이 제도는 부동산소유권의 이전 계약을 체결한 자가 그 거래사항을 기재한 계약서에 시·군·구청의 검인을 받아 등기를 신청할 시에 이를 제출하도록 한다.
한편「부동산 거래신고 등에 관한 법률」상의 ‘거래신고제도’가 함께 운영되고 있는데, ‘거래신고제도’는 “부동산 거래 등의 신고 및 허가에 관한 사항을 정하여 건전하고 투명한 부동산 거래질서를 확립하고 국민경제에 이바지함”을 목적으로 제정된 것으로「부동산등기 특별조치법」상의 검인제도와 중복되는 면이 있다 할 것이다.
「부동산등기 특별조치법」상의 검인제도의 도입 당시의 입법적 목적은 여전히 타당하다 할 것이지만 ‘거래신고제도’라는 국토교통부 소관의 다른 유사 제도가 존재하고 있다는 점과 ‘검인제도’ 그 자체에 대한 제도적 개선이 요구된다는 점에서「부동산등기 특별조치법」상 검인제도의 개선방안에 관한 검토가 필요하다 할 것이다.
이에 본 논문은「부동산등기 특별조치법」상 검인제도의 개관을 통해 유사 제도와의 중복되는 부분을 검토하고, 이를 통해「부동산등기 특별조치법」상 검인제도의 효율적 운영을 위한 개선방안을 제시하고자 한다.

영어초록

Under the current Act on Special Measures for Registration of Real Estate, the seal system requires a person to apply for a transfer of real estate ownership and directly regulates various expedient or illegal acts of applying for false or insolvent registration used as a means of real estate speculation or avoiding transaction restrictions to curb real estate speculation, so that the person who enters into a contract to transfer real estate ownership to establish a sound real estate transaction order by matching the details of the registered property and the actual transactions.
Meanwhile, the Report System on Real Estate Transactions under the Act on Report on Real Estate Transactions, etc. is also being operated, and the Report System on Real Estate Transactions, enacted for the purpose of establishing the transparent report system and contributing to the national economy by prescribing the matters concerning the report and permit on the real estate transactions, etc. It currently overlaps with the seal system under the Act on Special Measures for Registration of Real Estate.
Although the legislative purpose at the time of the introduction of the seal system under the Act on Special Measures for Registration of Real Estate is still reasonable, it will be necessary to review the improvement of the seal system under the Act on Special Measures for Registration of Real Estate, given that other similar systems under the jurisdiction of the Ministry of Land, Infrastructure and Transport, called the Report System on the Real State Transactions, exist and that institutional improvements are required for the seal system itself.
Therefore, this paper will review the overlaps with the similar system through reviewing the seal system under the "the Act on Special Measures for Registration of Real Estate" and to present improvement measures for the efficient operation of the seal system under the Act on Special Measures for Registration of Real Estate".
